With Trump’s victory and the belated realization that wokeness has pushed the normies Too Far, there’s talk that the poison of social justice will finally die a well deserved death in the name of improving Democratic Party election chances.
I remain skeptical.
With the woke retreating to Bluesky in order to further isolate themselves from #WrongThink and all those hateful, hateful facts, it seems like the woke will be clinging more bitterly to their anti-rational, low calorie religion substitute than ever before.
Still, there are some signs of progress here and there, so let’s cover a few instances of pushback against wokeness.
Trump II will have a chance to purge wokeness from the federal bureaucracy, but it’s going to be a long, hard struggle.
As president elect, Donald Trump has already begun discussing his plans to weed out “Marxist diversity, equity, and inclusion bureaucrats” from the nation’s universities and to take aim at schools that continue to discriminate by race “under the guise of equity.”
But dismantling the federal government’s massive DEI bureaucracy, which has ballooned under the direction of President Joe Biden, and rooting out illiberal and unconstitutional racial preferences the Left has deeply embedded into the government and into law will be a yearslong effort, conservative civil-rights lawyers and activists told National Review.
“This is not a short-term project,” said Dan Morenoff, executive director of the American Civil Rights Project, which specializes in fighting identity-based discrimination.
Undoing the Biden administration’s “Equity Agenda” will take not only executive orders from Trump, but also congressional action, efforts by Trump-appointed agency heads, notice-and-comment rulemaking, and likely continued lawsuits from civil-rights groups.
“The president has some real power to get this ball rolling and to dictate where the ball is going, but there are things that are going to take some additional steps,” Morenoff said.
Taking office in the wake of George Floyd’s killing in Minneapolis and the racial-justice riots that engulfed many American cities, Biden — who owed his presidency to support from the black community — made so-called equity an immediate priority.
On his first day in office, Biden signed Executive Order 13985, or Advancing Racial Equity and Support for Underserved Communities Through the Federal Government, in part to combat the “systemic racism” he claimed still plagues the nation’s institutions. But even as his administration lost repeatedly in the courts and voters soured on the concept, Biden doubled down with additional orders and a whole-of-government approach to DEI, preferences for select minority groups, and identity politics.
Biden commanded the heads of federal departments and agencies to establish Equity Teams, which were directed to submit annual Equity Action plans to the White House.
A report last month from Do No Harm, a medical watchdog, identified over 500 active or planned DEI actions by federal agencies. A new report from Open the Books, a government transparency group, found that the Department of Health and Human Services alone has about 300 staffers dedicated to diversity at an annual cost of $38.7 million.
Under Biden, aid to small businesses and farmers, contracts, scholarships for students, homeless services, and community-development funds for local governments were all provided with an eye on benefiting certain, often arbitrarily defined, minority groups.
The Wisconsin Institute for Law & Liberty (WILL), a conservative law firm that has successfully fought the Biden administration’s discriminatory programs in court, has counted more than 60 programs written into the U.S. Code that continue to provide grants, rebates, set-asides, preferences, waivers, price caps, and discounts based on racial preferences.
Dan Lennington, a WILL lawyer, said Biden’s plan was to “re-orient the entire federal bureaucracy towards eliminating all racial disparities. And what that meant was that in every area — assistance to farmers, to small businesses, in health care, all facets of American life — Biden directed the federal bureaucracy to treat racial groups differently, to give a benefit to some and not a benefit to others.”
In addition to signing executive orders, Biden was “tremendously successful” at signing racial preferences into law through the American Rescue Plan Act, the Bipartisan Infrastructure Bill, and the Inflation Reduction Act, Lennington said. Some of those set-asides have been blocked by the courts, including a loan-forgiveness program for black farmers, but many others remain.
All Biden’s social justice executive orders need to be cancelled and replaced by Trump, and all statutory instances need to be repealed.
With President-elect Donald Trump’s victory, radical and discriminatory Diversity, Equity and Inclusion programs could be — finally — on the way out.

The Biden-Harris team itself was birthed by DEI, after then-candidate Joe Biden came under intense pressure to pick a “woman of color” as his running mate.
His choice, Kamala Harris, fully embraced DEI in her 2024 campaign, even creating Zoom calls for different racial, ethnic and sex-based interest groups: “White Women for Harris,” “white dudes,” “black women” and so on.
Turns out, voters didn’t buy Harris or the DEI she was selling
Trump’s win, driven by a broad multi-racial, multi-ethnic, multi-religious coalition, puts DEI on life support.
It’s time to pull the plug and let DEI die.
In a July 2023 video posted as part of his Agenda 47 policy series, Trump focused heavily on his promise “to fire the radical Left accreditors that have allowed our colleges to become dominated by Marxist Maniacs and lunatics.”
Elon Musk, Trump’s new government-efficiency adviser, re-circulated the video this week, indicating its importance in the president-elect’s agenda.
Focusing on accreditors will make a real difference long-term.
The US Department of Education has oversight authority over higher education accreditation agencies — and groups like the American Bar Association, for example, use legislative-appointed near-monopoly status as a means of driving DEI into universities and graduate schools.
Trump has also promised that his Department of Justice will “pursue federal civil rights cases against schools that continue to engage in racial discrimination,” defying the Supreme Court’s landmark 2023 decision outlawing affirmative action in admissions
We are all for that, but to ramp up the pressure Trump should also empower private parties to pursue those actions.
Our Equal Protection Project has filed more than 40 civil rights complaints with the Department of Education, leading half of the schools involved to change or drop discriminatory criteria after adverse publicity and public shaming.
But don’t leave it to slow-acting government agencies alone to do this work: Trump can also work with Congress to empower groups like ours, giving us standing to sue in court in our own name under civil rights laws and agency regulations.
Individual victims of DEI often fear retribution and will not sue in their own name, so their grievances go unanswered.
If advocacy groups have standing in court, we can pursue their cases while protecting victims’ safety.
All of the above are systemic changes that will have a lasting impact.
But the quickest fix should be Trump’s highest priority: Cutting off the supply of money that feeds the DEI industrial complex on campuses and elsewhere.
People are entitled to their viewpoints, but they are not entitled to federal money to promote discriminatory conduct.
The federal government must eliminate funding for any program, anywhere in the federal government, that includes race- or ethnicity-based eligibility or preferences — including the use of DEI statements for admission, hiring or promotion.
Indeed, it’s also time to cut federal funding completely for any institution, public or private, educational or otherwise, that uses such discriminatory DEI criteria.
This is all good advice, but it’s easier said than done. If you’re going to get that legislation passed, it has to be part of Trump’s first budget where it cane be passed through reconciliation, because wokeness is still the Democratic Party’s religion, and they will filibuster any attempt to purge the bureaucracy. You’ll probably need to at least amend the Pendleton Act as part of the budget process to specify that Administration’s power to lay off employees, and the senate needs to have the starch to let Trump kill off vast swathes of government agencies. No phase outs, no “oh, look at the out-year savings” shenanigans. Hundreds of departments and agencies need to be eliminated, not pruned. Zeros don’t grow back.
As we recently reported, President-elect Trump pledged to set up a Task Force to look at the infiltration of DEI into the U.S. military…You remember Matt Lohmeier. He is the former Space Force Lieutenant Colonel squadron commander who was fired, forced to resign without a pension just before his retirement date and subjected to an Inspector General investigation within the Pentagon after publishing his bestselling book, Irresistible Revolution: Marxism’s Goal of Conquest & the Unmaking of the American Military, which tore the lid off the military’s obsession with racist and radical “woke” ideologies.

And, as we reported, President-elect Trump has pledged to appoint Matt to the Task Force charged with dismantling DEI in the U.S. military. [And] on Tuesday, the Wall Street Journal reported that President-elect Trump is indeed considering cleaning house at the Pentagon:
Trump Draft Executive Order Would Create Board to Purge Generals:
The Trump transition team is considering a draft executive order that establishes a “warrior board” of retired senior military personnel with the power to review three- and four-star officers and to recommend removals of any deemed unfit for leadership.
If Donald Trump approves the order, it could fast-track the removal of generals and admirals found to be “lacking in requisite leadership qualities,” according to a draft of the order reviewed by The Wall Street Journal. But it could also create a chilling effect on top military officers, given the president-elect’s past vow to fire “woke generals,” referring to officers seen as promoting diversity in the ranks at the expense of military readiness.
Note how the writer tries to cast this as a negative through the use of the phrase “chilling effect,” but what the writer fails to emphasize is that the current leadership in the Pentagon is all about wokeness and identity politics over merit, to the detriment of the national defense, as we have repeatedly reported:

The writer also fails to mention that when Barack Obama took over, he purged 197 Generals and Admirals from the ranks, no doubt to re-make the U.S. military in his image: Obama’s Military Coup Purges 197 Officers In Five Years.
In any case, given the current crop of senior military officers and their dedication to all things DEI, cleaning house is definitely in order to make sure the U.S. military returns to a focus on engaging with and killing the enemy, not being a laboratory for the latest left-wing social experiments.
Our military needs real warriors, not social justice warriors.
Closer to home, the Texas A&M has approved removal of 52 programs, including an LGBTQ studies minor.
The Texas A&M University (TAMU) System’s Board of Regents unanimously voted to remove 52 “low-producing” academic programs on November 7, including its controversial “LGBTQ Studies” undergraduate minor, after failing to pass certain threshold requirements recently established by the provost.
The board proposed a resolution on October 29 to eliminate 14 minors and 38 certificate programs found to be “low-producing” after they “reviewed minors and certificate programs to ensure adequate student interest and demand and to eliminate inefficient and low-producing programs,” according to new course thresholds designed by the Office of the Provost.
Per the new requirements proposed by Texas A&M University Provost Alan Sams, in order to maintain an active status as an A&M minor, the program must have graduated “a minimum of 10 students” within the past two school years as well as have at least five students plus five graduates enrolled in the current school year — thresholds the LGBTQ Studies and 13 other A&M minors allegedly fail to meet.
The board directed university President Mark Welsh III to “take actions necessary” for the elimination of such programs, including minors such as LGBTQ Studies, Global Art Design, and Asian Studies, and certificates including Regulatory Science in Food Systems, Cultural Competency, and Landscape Management.
Now all we need is follow-through, making sure those previously working to implement woke policies are handed their walking papers.
What a freaking epic (and tiring) week! I waited until Fox and Decision Desk had declared Trump the winner past 1 AM Wednesday morning, and then had to get up a few hours later to get ready to work. So we’ve got more election fallout, Israel bags more terrorist scumbags, Elon Musk and Ron Paul may team up to fight government waste, Texas continues to purge wokeness from public institutions, and a song mystery is solved.
Last time around, Trump squandered his momentum. He passed the tax bill that the establishment GOP wanted, after which they didn’t need anything from him and turned to obstructing him….
Like airplanes on a runway. Trump’s approach this time around should be what he should have done last time: Shock and awe. Shut down departments, fire bureaucrats, exercise emergency powers, all so fast that the establishment’s responses are saturated. Javier Millei’s whirlwind assault in Argentina should be the model, sometimes in specifics but also in general approach. Bureaucrats move slowly; Trump should move fast.
Elon Musk says he can cut $2 trillion easily; do it. Also, set bureaucrats competing with each other for what funds remain. Divide and conquer.
The FBI’s files on its policing of domestic dissent should be opened up, as should the details of the NSA’s illegal domestic spying. Trump should have outsiders investigate possible (likely) prosecutorial misconduct in the January 6 prosecutions – something judges have already raised – and fire those responsible, as well as subjecting them to what other legal consequences may apply. The lesson that the deep state can’t intervene in domestic politics needs to be driven home, and the only way to do that is to ruin a lot of lives on the part of people who deserve to have their lives ruined, from the top of the Justice Department and the intelligence agencies to the bottom. Likewise those involved in social media censorship programs, “Operation Chokepoint” style economic warfare, and the like. Abuse of government power against the citizenry should be treated as a criminal matter, because it is.
Trump should also announce that the federal government is waiving qualified immunity on the part of such officials.
There are lots more ideas – you can submit your own in the comments below, and the much-maligned Project 2025, though not actually a Trump initiative, contains some – and Bloomberg is already warning that if elected Trump will dismantle the White House’s gun control ministry. Oh no!
The specifics aren’t really the point here, though I should probably post another essay just about those. But the point here is rapid action across a wide variety of fronts. Trump should take advantage of the precedents that Biden has set for far-reaching executive action, though you can bet that when he does the press will pretend this is the first time anything like that has ever been done.
The story of how Harris pocketed record sums while failing to gain support from voters will be studied by campaigns for decades to come. Democrats who successfully pressured octogenarian President Joe Biden to pass the torch to the former California senator are now conducting an internal autopsy of the 2024 race, in which Trump raised and spent hundreds of millions of dollars less than Harris.
“A billion dollars paled in comparison to the increased prices Americans were seeing across the country,” Tom Fitton, president of the conservative group Judicial Watch and a longtime Trump ally, told the Washington Examiner. “Voters weren’t fooled.”
The Harris campaign and its affiliated committees dropped more than $654 million on advertising from July 22 to Election Day, whereas Trump spent $378 million, or 57% less, in the same category, according to data from AdImpact.
Future Forward, the $500 million “ad-testing factory” and super PAC that supported Harris, was a reliable clearinghouse for checks from wealthy Democrats such as Reid Hoffman, George Soros, Michael Bloomberg, and Dustin Moskovitz. And anonymous donations, or so-called “dark money,” also benefited Harris at a faster and more substantial clip than Trump thanks to lax federal laws that progressives often criticize but, nonetheless, exploited in 2024.
The Harris campaign declined to comment on its finances. A fuller portrait will be public after the election, as the Federal Election Commission mandates post-general election reports for candidates within 30 days.
In mid-October, the Harris campaign disclosed that it had spent over $880 million this election, almost $526 million greater than the roughly $354 million that the Trump campaign had disclosed spending, according to a Washington Examiner analysis of federal filings. Much of the Harris campaign’s spending was allocated for digital media advertising, polling, and travel from state to state, including to a private jet company called Advanced Aviation.
Payroll and the taxes that accompanied it accounted for $56.6 million of the Harris campaign’s spending. In comparison, the Trump campaign reported spending $9 million on payroll — employing hundreds fewer staff members.
There was also the army of political, digital, and media consultants who were paid over $12.8 million by the Harris campaign, filings show.
One vendor, Village Marketing Agency, received over $3.9 million and reportedly worked to recruit thousands of social media influencers to boost Harris online. Others that scored lucrative consulting gigs from the campaign included the likes of Precision Strategies, a Democratic-aligned marketing agency; Ethos Organizing, founded by former Ohio Democratic Party director Malik Hubbard; and the Biden-allied SKDK communications firm.

“Event production” was also a staple spending area of the Harris campaign, which notably hosted a star-studded lineup of musicians from Lady Gaga to Katy Perry for an election eve rally.
The campaign paid more than $15 million, according to federal filings, to companies for such services.
There was $1 million for Oprah Winfrey’s Harpo Productions on Oct. 15 in West Hollywood, California.
Winfrey, a top Harris ally, appeared at a town hall with the vice president in September and was at her final rally in Philadelphia before Election Day.
Viva Creative, a marketing agency that has touted its work with Oprah, comedian Trevor Noah, the Washington Nationals baseball team, and American Express, scooped up $1.8 million from the Harris campaign for event production from September to October. A company called Production Management One in Maryland received $1.7 million, with large payments also going to Vox Productions, Temple University, Wizard Studios North, the Park Hyatt Chicago, and other entities for event production, filings show.
Then there was Majic Productions, a Wisconsin-based company, which has worked the NBA playoffs, the Super Bowl, and at the Bellagio Hotel & Casino in Las Vegas. The Harris campaign paid that company $2.3 million.
A source familiar with the matter told the Washington Examiner that the Harris campaign spent six figures on building a set for Harris’s appearance on the popular Call Her Daddy podcast with host Alex Cooper. The interview came out in October and was reportedly filmed in a hotel room in Washington, D.C.
In the end, San Francisco mayor London Breed’s recent efforts to crack down on homelessness and crime weren’t enough to save her from the wrath of voters frustrated by years of disorder and talk of a “doom loop” in the famously progressive city.
After 14 rounds through the city’s ranked-choice voting process, Breed lost decisively to Daniel Lurie, a more moderate Democrat and a wealthy heir to the Levi Strauss fortune.
Lurie was ahead from the first round, and after 14 rounds led with 56.2 percent of the vote to Breed’s 43.8 percent, according to the San Francisco Department of Elections.
With San Francisco actually restoring sanity, pretty soon Austin will be the only crazy leftwing city left in America…

Today, the Board of Regents of Texas A&M University System pushed back against “shared governance” with woke faculty members. They voted to end 52 low-performing programs, including an LGBTQ minor.
Over the course of many months, State Rep. Brian Harrison (R-Midlothian) repeatedly criticized DEI courses and the LGBTQ studies minor at Texas A&M. In September 2024, a university spokesperson confirmed that they would deactivate 38 certificates and 14 minors, including the Lesbian, Gay, Bisexual, Transgender, and Queer Studies minor.
On November 7, the Board of Regents unanimously approved the deactivation of these programs by voice vote.
The only question is why it took so long to fight back against the woke mind virus…

Joe Rogan did a really great interview with J.D. Vance. The Trump interview was good, but Trump did his usual looping and weaving thing. Vance comes across as not only smart and confident, but seems (unlike Kamala Harris) extremely comfortable in his own skin.

We’ve passed the peak of woke politics in the U.S., and the Harris for president campaign is the leading indicator.
Of all the things that Kamala Harris wants you to know about her — that she grew up in a middle-class family, that she’s not Joe Biden, that she has a “to-do list” for the American people — perhaps foremost among them is that she’s not woke.
She doesn’t have any rote line asserting this, but achieving distance from the fashionable left-wing politics that defined the Trump years and their immediate aftermath motivates much of what she says and does.
That Harris now feels compelled to disavow so many of the ideas that she once embraced is powerful testament to their political toxicity.
An idea has won or lost in American politics when both parties favor or oppose it, or simply don’t want to fight over it anymore. Ronald Regan’s economics truly prevailed when the Democratic Party, via Bill Clinton in the early 1990s, accepted his basic approach. Gay marriage won politically when Republicans decided to stop talking about the issue.
By this standard, woke attitudes and policies are in marked decline, and Kamala Harris is Exhibit A.
Except for her abortion radicalism, she’s turned her back on much of what she once professed to believe or sympathize with.
Defund the police? Absolutely not.
Abolish ICE? No way.
DEI? Haven’t heard of it.
Medicare for all? That was a long time ago.
The Green New Deal? Let’s not get carried away.
She has backed off her extravagant positions on the trans issue and the border. She now insists that rather than pushing the envelope on either, she simply wants to follow the law. You could be forgiven for thinking the only pronouns she knows are she/her and he/him.
Harris doesn’t bring up identity politics at all. Not only does she not talk about the once-ubiquitous concepts of white privilege or “equity,” she doesn’t even talk about breaking the glass ceiling or the history-making nature of her candidacy. Listening to her campaign, you’d have no idea that the twin -isms, racism and sexism, have been consuming obsessions of the Left for years now.
But if she gets elected, just like Obama, she’ll abandon all of her moderate positions and rush back to her radical roots.
Former President Donald Trump says that if reelected, he’ll create a government efficiency task force — and that Elon Musk has already agreed to lead it. During a speech in New York on Thursday, Trump said the new efficiency commission would conduct a “complete financial and performance audit of the entire federal government” and make recommendations for “drastic reforms.”
I hope Musk gets out a big axe and that the Trump Administration actually balances the budget. (Hat tip: Borepatch.)

Records show the investment arm of two major Texas universities bought shares in more than 50 Chinese companies.
On September 23, the American Accountability Foundation exposed how the University of Texas/Texas A&M Investment Management Company’s asset managers advanced leftist ideology through their shareholder resolutions.
On October 17, UTIMCO President and CEO Richard Hall told state senators that he was “not happy with those votes” and the firm “would do better.”
However, a deeper dive into the records AAF acquired also revealed concerning investments. According to records, UTIMCO has invested money in Chinese companies.
UTIMCO allocated some of its assets to the following entities: Connor, Clark & Lunn Investment Management, JP Morgan Asset Management, and Acadian Asset Management. The three asset managers participated in shareholder votes in China-based companies, revealing the UTIMCO investments in these businesses.
In October 2023, Connor, Clark & Lunn participated in a shareholder vote for Topsec Technologies Group, a China-based cyber security company. Reuters reported that Topsec provides “network security products, big data products, and cloud services to customers in various industries such as government, finance, operators, energy, health, education, transportation, and manufacturing.”
There were shareholder votes for Huaneng Power International, Inc., a power company that boasts of being “one of the largest listed power producers” in China. Their parent company is China Huaneng Group Co., Ltd., which owns more than 50 percent of HPI shares. According to their website, the company is “a key state-owned company established with the approval of the [China] State Council.”
In December 2023, the management company Connor, Clark & Lunn Investment Management voted 19 times for electing various individuals as directors or supervisors of the Chinese company.

AAF records showed other investments into China by UTIMCO fund managers, including BOE Technology Group Co., Ltd., Haier Smart Home Co., Ltd., Opple Lighting Co., Ltd., and LONGi Green Energy Technology Co., Ltd.
A million-dollar cheating ring resulted in at least 210 unqualified teachers, including two sexual predators, receiving teacher certifications. The ring was exposed this week after the Harris County District Attorney’s Office filed charges against five individuals involved.
The alleged ringleader is Vincent Grayson, the head boys basketball coach at Houston’s Booker T. Washington High School.
Also charged are Tywana Gilford Mason, the teacher certification test proctor; Nicholas Newton, an assistant principal who served as the proxy test-taker; Darian Nikole Wilhite, another proctor; and LaShonda Roberts, an assistant principal at Yates High School who helped recruit would-be teachers.
All are charged with two counts of engaging in organized criminal activity.
Allegedly, candidates seeking certification would pay Grayson $2,500. He would then give a 20 percent portion to Gilford Mason, who would then allow Newton to sit for the test under the teacher’s name. The candidates would be given a testing time and location by Gilford Mason, then show up, sign in, and leave. Newton would then arrive and take the test for them.

The Biden-Harris administration’s ‘America Last’ policies have left the country vulnerable. Between draining the strategic petroleum reserve, sending hundreds of billions in cash and equipment to Ukraine (such as electrical transformers that are now needed for Hurricane Helene), and FEMA spending $640 million to help migrants, the agency tasked with emergency preparedness is now ‘broke,’ and doesn’t have enough money to get through hurricane season which typically lasts through November.
The agency is being stretched as it works with states to assess damage from Hurricane Helene and delivers meals, water, generators and other critical supplies. The storm struck Florida last week, then plowed through several states in the Southeast, flooding towns and killing more than 160 people.
Mayorkas was not specific about how much additional money the agency may need, but his remarks on Air Force One underscored concerns voiced by President Joe Biden and some lawmakers earlier this week that Congress may need to pass a supplemental spending bill this fall to help states with recovery efforts.

The Trafalgar Group released a poll on Wednesday showing Trump has increased his lead in the vital swing states of Michigan and Wisconsin.
The recent poll shows Trump beating Harris by 2.2 points in Michigan, with Trump scoring 47.5% of the votes to Harris’s 45.3%.
On August 31, the Trafalgar Group had Trump beating Harris 47% to 46.6%, a lead of only 0.4%.
Trump is winning in Wisconsin as well, topping the Kackler by 47.1% to 46%. The poll had Trump at 47.3% to Harris’s 46.2%.
“These numbers are the best we’ve seen for Trump in this election cycle. If this momentum holds, he could easily win by a significant margin,” a polling source stated.
In Pennsylvania, which many pundits believe Harris needs to win, Trump is up, with 47.5% of the vote, compared to Harris’s 45.3%.
The Biden-Harris administration has allowed well over half a million illegal aliens with criminal histories to enter the United States.
U.S. Rep. Tony Gonzales (R-23) published the U.S. Immigration and Customs Enforcement data on social media platform X.
According to the newly released information, 662,566 noncitizens on ICE’s national docket have criminal histories. These numbers include 13,099 murder convicts, 15,811 sexual assault convicts, and 13,423 weapon offense convicts.
“We’ve known for far too long that the Biden-Harris border crisis poses a direct threat to Americans,” Gonzales said in a press release. “The truth is clear—illegal immigrants with a criminal record are coming into our country.”
The Texas congressman asserted that beyond the disturbing new data, it should also serve as a “wake-up call” for the federal government and cities across the United States that keep sanctuary policies in place.
Gonzales first requested the data on March 13 when he penned a letter requesting answers to several illegal immigration questions to President Joe Biden and U.S. Department of Homeland Security Secretary Alejandro Mayorkas.
Of the seven million reported cases on ICE’s docket, the letter requested information on how many noncitizens were charged with a crime by a municipality. Additionally, the letter asked how many were noncitizens convicted of a crime and released into U.S. communities.

A Texas A&M spokesperson has confirmed that the university will deactivate 38 certificates and 14 minors, including the Lesbian, Gay, Bisexual, Transgender, and Queer Studies minor.
The A&M spokesperson told The Battalion that the official list of deactivated programs will not be public until it appears before the Faculty Senate on October 14. A university statement cited low enrollment as the reason for deactivating the programs.
However, Theresa Morris, the director of the Women’s and Gender Studies Program, said that the LGBTQ Studies minor was among those ending.
An official in the Department of Communication & Journalism also confirmed that certificates for both Communication, Diversity and Social Justice and Communication & Global Media are being deactivated.
Additionally, the director of Marketing and Communications in the College of Performance confirmed that the certificates for popular culture and performing social activism were also in the deactivation process.
This comes after State Rep. Brian Harrison (R-Midlothian) repeatedly called DEI courses and the LGBTQ studies minor an “outrageous abuse of tax money” and examples of “taxpayer-funded indoctrination.”

“Lawsuit Accuses Democrat State House Candidate of Not Paying Vendors. House District 80 Democrat candidate Cecilia Castellano is already under investigation by Attorney General Ken Paxton in a separate voter fraud case.”
A lawsuit filed in Tarrant County is accusing a Democrat running for the Texas House of Representatives of failing to pay her vendors and subcontractors in the business she operates.
House District 80 candidate Cecilia Castellano, who operates Azteca Designs and Construction, allegedly failed to provide proper compensation for work done by one of Azteca’s subcontractors, the Glass Doctor of North Texas, according to the suit.
Glass Doctor had entered an agreement to work on a project with Azteca in November 2023, where the subcontractor was slated to earn $49,643.36, according to the filing. Later, Glass Doctor was tasked with replacing damaged glass installed by another subcontractor for an additional $18,487.77.
However, Glass Doctor says the payments never arrived.
Plaintiffs instead painted a picture of Azteca going out of their way to avoid providing the payments, claiming the project was “not built pursuant to written plans” and back-charging Glass Doctor to fix work done by a third party.
Fort Bend County Judge KP George has been indicted on misdemeanor charges related to faked racist messages on social media but could face felony charges over an alleged attempt to hide evidence.
A grand jury indicted George last Thursday in relation to a scheme in collaboration with Taral Patel, his former chief of staff and now Democratic candidate for county commissioner. Patel was indicted on four felony and four misdemeanor charges after investigators tied him to fake social media and email accounts used to make offensive posts and circulate falsified polls.

President Joe Biden looked old and disoriented during Thursday’s CNN debate with Donald Trump. He spoke in a quiet and hoarse voice, made some incoherent answers, and often stumbled over his own words.
It was a lackluster performance that played directly into Republican depictions of the 81-year-old president – the oldest president in American history — as too old and frail to serve another four years in office. Trump said as much during the debate.
“He’s not equipped to be president,” Trump said. “You know it and I know it.”
The debate was a highly personal affair between two men who made little effort during their nearly two hours on stage to contain their disdain for one another.
Biden called Donald Trump a “loser,” and a “whiner” with the “morals of an alley cat.” Trump accused Biden of turning the United States into a “third-world nation” and of being the “worst president in history by far, and everybody knows it.”
Trump turned in a spirited performance, hammering Biden on inflation and the immigration crisis under his watch. But Biden’s struggles seemed to be the major takeaway for CNN’s post-debate panel, which reported that senior Democrats are in an “aggressive panic” over their party leader’s apparent frailty.
Speaking about improvements he’s claiming at the border, Biden at one point seemed lost, saying: “I’m going to continue to move until we get the total ban on, the total initiative relative what we’re going to do with more border patrol and more asylum officers.”
“I don’t really know what he said at the end of that sentence,” Trump replied. “I don’t think he knows what he said either.”
At another point, Biden got visibly lost when talking about his plan to raise taxes on the wealthy to wipe out the debt, saying he wanted to make sure “that we’re able to make every single solitary person eligible for what I’ve been able to do with, with, with the Covid, excuse me, with dealing with everything we had to do with, look, we finally beat Medicare.”
“Well, he’s right,” Trump said, “he did beat Medicare. He beat it to death.”
He stammered. He stumbled. And, with fewer than five months to November, he played straight into Democrats’ worst fears — that he’s fumbling away this election to Donald Trump.
The alarm bells for Democrats started ringing the second Biden started speaking in a haltingly hoarse voice. Minutes into the debate, he struggled to mount an effective defense of the economy on his watch and flubbed the description of key health initiatives he’s made central to his reelection bid, saying “we finally beat Medicare” and incorrectly stating how much his administration lowered the price of insulin. He talked himself into a corner on Afghanistan, bringing up his administration’s botched withdrawal unprompted. He repeatedly mixed up “billion” and “million,” and found himself stuck for long stretches of the 90-minute debate playing defense.
And when he wasn’t speaking, he stood frozen behind his podium, mouth agape, his eyes wide and unblinking for long stretches of time.
“Biden is toast — calling it now,” said Jay Surdukowski, an attorney and Democratic activist from New Hampshire who co-chaired former Maryland Gov. Martin O’Malley’s 2016 presidential campaign in the state.
In text messages with POLITICO, Democrats expressed confusion and concern as they watched the first minutes of the event. One former Biden White House and campaign aide, granted anonymity to discuss the matter, called it “terrible,” adding that they have had to ask themselves over and over: “What did he just say? This is crazy.”
Sales of previously owned homes are sitting at a 30-year low and didn’t move much in May as prices hit a new record and mortgage rates remain high.
So-called existing home sales in May were essentially flat, down 0.7% from April to a seasonally adjusted, annualized rate of 4.11 million units, according to the National Association of Realtors, or NAR. Sales fell 2.8% from May of last year …
The median price of an existing home sold in May was $419,300, a record-high price in the Realtors’ recording and up 5.8% year over year. The gain was the strongest since October 2022. Prices gained in all regions.
The Realtors noted in a release that the mortgage payment for a typical home today is more than double what it was five years ago.
It’s almost as though the Biden Recession, constrained supply (a great deal from blue locale regulation that prevent housing from being built), and high interest rates mean that no one wants to buy or sell.

Inflation, which has surged during Biden’s presidency, certainly exacerbates this issue. Rising costs for essentials like food, gas, and utilities leave renters with even less disposable income to cover their housing costs. Despite promises to address affordability and economic inequality, the Biden administration has doubled down with claims that inflation is going down and that wage growth has outpaced it — which isn’t true. Biden has made it more difficult for Americans to achieve financial stability.

The Supreme Court on Friday issued a ruling overturning the 1984 Chevron v. National Resources Defense Council case, striking down a previous decision that granted federal agencies immensely broad power to draw up regulations without congressional approval.
The Court ruled in both Loper Bright Enterprises v. Raimondo and Relentless v. Department of Commerce — two nearly identical cases — that regulatory agencies will no longer be able to fill in the blanks of vague legislation in 6-2 and 6-3 decisions, respectively. Justice Ketanji Brown Jackson recused herself from the first case because she sat on the federal appeals court that had previously heard the case.
In his majority opinion, Chief Justice John Roberts wrote that it is not the place of agencies to clarify ambiguous legislation.
“Perhaps most fundamentally, Chevron’s presumption is misguided because agencies have no special competence in resolving statutory ambiguities,” he wrote. “Courts do. The Framers, as noted, anticipated that courts would often confront statutory ambiguities and expected that courts would resolve them by exercising independent legal judgment.”
Writing a concurrence, Justice Neil Gorsuch argued that the concept of Chevron deference “undermines” many of the principles on which the United States was founded.
“It precludes courts from exercising the judicial power vested in them by Article III to say what the law is,” he wrote. “It forces judges to abandon the best reading of the law in favor of views of those presently holding the reins of the Executive Branch. It requires judges to change, and change again, their interpretations of the law as and when the government demands.”
This is a huge blow to the unchecked administrative state and a key decision in helping reign in untrammeled executive regulatory power.
This looks like it will put a crimp in Biden’s amnesty plans: “SCOTUS rules 6-3 that there’s no constitutional guarantee for non-citizen spouses to be admitted to the US.”

Federal judges in Missouri and Kansas issued separate rulings on June 24 blocking key sections of the Biden administration’s Saving on a Valuable Education (SAVE) program, which is designed to lower student loan payments and forgive debts.
A new version of the program that would reduce payments and shorten maximum repayment periods was set to take effect in July.
U.S. District Judge Michael Crabtree for the District of Kansas ruled that the Republican states were likely to succeed in their claim that the department lacked explicit congressional authority to enact this portion of the program.
“Defendants have offered colorable, plausible interpretations of the Higher Education Act that could authorize the SAVE Plan, but those interpretations fall short of clear congressional authorization,” Judge Crabtree, who was appointed under President Barack Obama, wrote on Monday.
However, he declined to block the program entirely, expressing concerns about the practicality of reversing parts of the plan that had already been implemented. He also said that Republicans’ delay in filing their lawsuits undermined their arguments that there was an immediate need to halt the entire program.
In a separate decision on the same day, U.S. District Judge Judge John Ross for the Eastern District of Missouri, also a President Obama appointee, blocked the department from forgiving “any further loan[s]” under SAVE until he decides the full case. His order said that such actions would likely strip state loan operators of revenue.
Judge Ross also suggested that the SAVE program might have exceeded the authority of Education Secretary Miguel Cardona and that Missouri would likely be harmed by the program.

After a while, it became a parody worthy of classic comedy skits: the Biden administration’s reflexive need to launch into a condemnation of “Islamophobia” every time the discomfiting topic of antisemitism came up — which, you may have noticed, it does quite a bit these days.
Progressives hate antisemitism. Not, unfortunately, the concept . . . the word. It holds a mirror up to their internal contradictions.
Jews have been among the most consequential, cutting-edge progressives in history. A few months back, I reviewed Democratic Justice, Brad Snyder’s biography of Felix Frankfurter, who may have been as responsible for forging the dominance of American progressivism as Franklin D. Roosevelt, the president he zealously served. Alas, Frankfurter would not be welcome today in what’s become of his movement — not least because of another project on which he collaborated with his mentor and fellow Supreme Court justice, Louis Brandeis: Zionism. That project is anathema to today’s progressives. It honors the old order and the uniqueness of a people reified in their ancestral homeland, one in which they dwelled for millennia — before Islam existed and, 14 centuries later, the notion of “Palestinians” was conceived.
Moreover, to highlight antisemitism is intolerably inconvenient to the collaboration of highest priority for modern progressives: Their partnership with sharia supremacists — so-called Islamists, adherents to “political Islam.”

Ostensibly, it’s an unlikely partnership: Sharia supremacists despise many signal progressive causes — e.g., abortion, equality for women, civil rights for homosexuals, and “gender fluidity.” (How long do you figure the “activists” waving their “Queers for Palestine” placards would actually last in Gaza?) And it seems odd for progressives, infamously intolerant of religious liberty, to make common cause with unabashed theocrats who would impose on society a systematically discriminatory legal code enforced by barbaric punishments — of the terrorizing kind that, not coincidentally, the Brotherhood’s Hamas jihadists inflicted on Israeli men, women, and children on October 7.
But let’s dig deeper. The ne plus ultra for sharia supremacists and leftists is the extirpation of the established order. Yes, they have very different ideas about what should replace that order; but that’s an argument for later (at which point progressives would find themselves in the unenviable position of the appeaser after the crocodile is done devouring everyone else). For now, it is a marriage of convenience, a joint war of conquest against Western civilization.
Marriages of convenience are not big on commitment and loyalty. Hence, Jews — predominantly on the left, with legions of stalwart progressives who would as reflexively rebuke Islamophobia as any good Democrat — have become a casualty of that war.
The sharia-supremacist hatred of Jews is doctrinal. As the Hamas Charter relates, Islamic eschatology is consumed by an end-of-times war in which even trees and stones will help Muslims kill their mortal enemies, the Jews. The Islamic claim on the land “from the River to the Sea” also stems from scripture: Mohammed’s night ride from Mecca to Jerusalem and on to heaven. And Muslim scripture further holds that Islam’s prophet died upon being poisoned to death by a Jewish woman.
This is all very uncomfy for progressives. They really don’t do doctrine, let alone submit — or at least allow themselves to appear to be submitting — to religious doctrine. Thus must they engage in euphemistic games to sidestep reality.

Democrats wouldn’t clean up San Francisco for mere citizens, but they did it for a communist dictator.
Apparently, the city of San Francisco can indeed clear out the tent cities of homeless, remove the human feces and hypodermic needles from the sidewalks, and make the downtown look sparking clean and shiny in just a matter of days. All it takes is sufficient motivation — like hosting a visit from Chinese dictator Xi Jinping.
Even the New York Times can’t deny the irony that the arrival of Xi and a plethora of overseas leaders is spurring efforts that, presumably, could have been started and carried out at any point with enough motivation:
On Market Street, the city’s main thoroughfare, maintenance workers resurfaced uneven sidewalks and installed plywood over empty tree wells.
Nearby, a crew gave a long-derelict plaza a makeover by turning it into a skateboard park and outdoor cafe with ping-pong tables, chess boards and scores of potted plants. Elsewhere, workers painted decorative crosswalks and new murals, wiped away graffiti, picked up piles of trash and removed scaffolding to show off a refurbished clock tower at the Ferry Building. . . .
Perhaps the most obvious change has been seen at the Speaker Nancy Pelosi Federal Building at the corner of Seventh and Mission Streets, less than a mile from the conference center.
Before we go any further, can I just point out how infuriating it is that we live in a country with so many genuinely heroic, inspiring, and under-recognized figures, and yet we name things after politicians whose greatest achievements were bringing back a lot of federal funds to their constituents? I realize in the state of West Virginia, that statement is blasphemy.
In a perfect irony, in August, “Officials at the U.S. Department of Health and Human Services advised hundreds of employees in San Francisco to work remotely for the foreseeable future due to public safety concerns outside the Nancy Pelosi Federal Building on Seventh Street.” As Iowa GOP senator Joni Ernst noticed, to protect the building named after the House speaker who said that border walls are “immoral,” federal officials put up a high chain-link fence.
In other words, the official assessment of the federal government is that the Nancy Pelosi Federal Building is not a safe place for anyone, which strikes me as a heavy-handed metaphor.
Anyway, back to the Xi-driven cleanup:
For two years, a stubborn fentanyl market at the corner and a sprawling homeless encampment across the street became neighborhood fixtures. People regularly used drugs in an adjacent alley.

It’s almost like the city government of San Francisco perceives Xi Jinping as the boss it needs to impress, instead of the voters whose exorbitant taxes (including an 8.625 percent sales tax!) pay city employees’ salaries. If the city is worth making safer, cleaner, and more attractive for a visit by Xi, President Biden, and a whole bunch of diplomats . . . why isn’t it worth making safer, cleaner, and more attractive for the full-time residents?

Two tightly connected things happened in Washington, D.C., on November 8: a “high-end” brothel serving “elected officials” was shut down by the FBI, and the U.S. House approved a controversial $300 million new headquarters building for the weaponized agency.
In announcing the brothel’s bust, the Department of Justice explained that the sex-trafficking operation served “elected officials, high tech and pharmaceutical executives, doctors, military officers, government contractors that possess security clearances, professors, attorneys, scientists and accountants, among others.”
The press release named the brothel operators: Han “Hana” Lee, 41, of Cambridge, MA; James Lee, 68, of Torrance, CA; and Junmyung Lee, 30, of Dedham, MA.
In lurid detail, the Department of Justice explained how the operators advertised their services—primarily young Asian women—for high-end customers. In order to utilize the prostitution services of the brothel, prospective clients allegedly completed “a form providing their full names, email address, phone number, employer and reference if they had one.”
Not mentioned in the press release were the names of the customers.
The announcement was made just ahead of a vote in the U.S. House, which would have defunded the $300 million new headquarters building proposed for the FBI. The facility, to be built in Maryland, will reportedly be larger than the Pentagon. The Pentagon has a total floor area of 6.5 million square feet and offices 23,000 military and civilian employees.

A BuzzFeed feature story from 2018 about a journalist who told a group of schoolchildren that he was gay was taken down just a day after it was announced that he had been brought up on child pornography charges.
Slade Sohmer, 44, the former editor-in-chief of the left-leaning video-driven news site The Recount, was freed on $100,000 bail on Monday after he was charged in Massachusetts court with possessing and disseminating “hundreds of child pornography images and videos.”
He has pleaded not guilty to two counts of possession of child pornography and two counts of dissemination of child pornography.

The person who paid as much as six figures for “artwork” by an untrained painter also received a prestigious government appointment from the artist’s father, President Joe Biden.
Now congressional investigators want to know if Biden’s decision to name Elizabeth Hirsh Naftali to the U.S. Commission for the Preservation of America’s Heritage Abroad was in any way related to her purchase of artwork by Hunter Biden, a middle-aged man who paints as a hobby.
House Committee on Oversight and Accountability Chairman James Comer (R-KY) is now asking Naftali and White House Counsel Stuart Delery to answer questions as to whether the Biden family is using Hunter’s “art” as a means of selling White House access.
The White House has previously claimed the identity of Hunter Biden art purchasers would be concealed to prevent any undue influence, but nothing prevents the purchaser from identifying themselves to Joe Biden when seeking an appointment, and now at least one purchaser has been identified as someone who sought White House access.
Senator Robert Menendez (D., N.J.), the chairman of the Senate Foreign Relations Committee, was indicted on corruption charges by federal prosecutors on Friday morning in a Manhattan court in an influence-peddling scheme involving Egypt.
The unsealed indictment revealed that Menendez’s wife, Nadine, New Jersey real estate mogul Fred Daibes, and two other business associates are being charged along side the lawmaker.
Led by Southern District of New York attorney Damian Williams, in June 2022, investigators conducted a search of Menendez’s residence in New Jersey and found $100,000 worth of gold bars, nearly half a million dollars in cash, “much of it stuffed into envelopes and hidden in clothing, closets, and a safe,” and a brand new Mercedes-Benz C-300 convertible.
“Menedez and Nadine Menedez agreed to and did accept hundreds of thousands of dollars of bribes in exchange for using Menedez’s power and influence as a Senator to seek to protect and enrich” his allies “and to benefit the Arab Republic of Egypt,” the indictment reads. “Among other actions, Menendez provided sensitive U.S. government information and took other steps that secretly aided the Government of Egypt,” the filing notes.
New York City will cut overtime pay for its police officers and three other agencies to help reduce costs driven by the city’s unprecedented migrant crisis, City Hall announced Monday.
Jacques Jiha, the budget director for Mayor Eric Adams’s administration, told the city’s police, fire, corrections, and sanitations departments in a Saturday memo to each submit an overtime pay reduction plan “to reduce year-to-year OT spending.”
He also wrote the four departments must submit monthly reports “to track overtime spending and their progress in meeting the reduction target” once Adams issues the order.
Jiha also noted the current assistance provided by President Joe Biden and New York governor Kathy Hochul is not enough, prompting City Hall’s decision to cut overtime pay among other financial measures.
“The amount of aid we have received from the federal government and the state has been grossly inadequate and there has been no progress on a statewide or national decompression strategy,” Jhia wrote in the memo, first reported by Politico. “The city can no longer continue to shoulder these skyrocketing costs and balance the budget without making very difficult choices.”
Crime has risen in New York in recent months as more than 100,000 illegal immigrants have poured into the city.
The leader of a police union said the overtime pay cuts will lead to fewer cops patrolling the streets, resulting in more staffing shortages.
“It is going to be impossible for the NYPD to significantly reduce overtime unless it fixes its staffing crisis,” Patrick Hendry, head of the Police Benevolent Association, told the New York Post. “We are still thousands of cops short, and we’re struggling to drive crime back to pre-2020 levels without adequate personnel.”
“If City Hall wants to save money without jeopardizing public safety, it needs to invest in keeping experienced cops on the job,” he said.

Dallas Mayor Eric Johnson switches to the Republican Party. “While Dallas has thrived, elsewhere Democratic policies have exacerbated crime and homelessness.”
“I have been mayor of Dallas for more than four years. During that time, my priority has been to make the city safer, stronger and more vibrant,” Johnson wrote in his article.
“That meant saying no to those who wanted to defund the police. It meant fighting for lower taxes and a friendlier business climate. And it meant investing in family friendly infrastructure such as better parks and trails.”
Johnson said he does not plan to alter his “approach” to being mayor but is switching his party affiliation.
“When my career in elected office ends in 2027 on the inauguration of my successor as mayor, I will leave office as a Republican,” Johnson said.
The mayor was a leading opponent of calls to decrease funding for the Dallas Police Department after the 2020 demonstrations against police violence. Johnson proposed cutting salaries at city hall instead.
In his announcement, he also touted Dallas’ decreasing crime rate and the Dallas City Council’s reduction of the property tax rate.
While city mayors are nonpartisan officeholders in Texas, Johnson was a Democrat during his nearly five terms in the Texas House of Representatives.
This is both unexpected and big news. Lots of Hispanic politicians in Texas have switched to the GOP, but this is the first case I can remember of a high profile black Texas Democratic politician switching to the GOP.
A 35-year-old Renton man was sentenced on Sept. 13 in U.S. District Court to 40 months in prison for his role in a plot to burn the Seattle Police Officers Guild building in downtown Seattle during the September 2020 protests.
The defendant, Justin Christopher Moore, pleaded guilty in September 2022.
At the sentencing hearing, U.S. District Judge Lauren King said, “What you did showed a complete disregard for human life. Our ability to peacefully assemble is a fundamental right to our society. Your acts of violence can deter people from exercising that fundamental right.”
According to records filed in the case, Moore made and carried a box of 12 Molotov cocktails in a protest march to the Seattle Police Officers Guild building on Sept. 7, 2020. Ultimately the marchers were moved away from the building in downtown Seattle. Police smelled gasoline and grew concerned about the intentions of protesters. The box containing the 12 gasoline devices was found in the parking lot next to the Seattle Police Officers Guild building.
Using video from that day and from other protests, as well as information from the electronic devices of other co-conspirators, Moore was confirmed as the person seen carrying the box of destructive devices.
In June 2021, law enforcement executed a search warrant at Moore’s residence. They seized clothing that is consistent with the images of what Moore was wearing when he carried the Molotov cocktails. From the basement storage area, they also recovered numerous items that are consistent with manufacturing explosive devices. Law enforcement recovered a notebook in which Moore had made entries related to the manufacturing of destructive devices and the ingredients necessary.
University of North Texas tries to cancel musicology professor. Professor wins in court. Again.
The Fifth Circuit Court of Appeals has handed down another defeat to the University of North Texas and a victory to Allen Harris in a lawsuit defending the First Amendment rights of Professor Timothy Jackson, after UNT shut down his journal, The Journal of Schenkerian Studies. The decision can be located here.
In January of last year, Allen Harris had already prevailed in the United States District Court for the Northern District of Texas. The District Court Judge Amos Mazzant rejected UNT’s motion to dismiss the complaint of Professor Timothy Jackson in a strong decision available here.
Ordinarily, the case would then proceed to discovery and eventually to trial. But UNT invoked its right to a special appeal (called an interlocutory appeal) that is allowed only to the state under the doctrine of sovereign immunity. At first, Texas was expected to make an argument defending UNT’s right to do whatever it wanted with Timothy Jackson’s journal.
The Journal of Schenkerian Studies is dedicated to a late 19th/early 20th-century Austrian-Jewish music theorist, Heinrich Schenker, and his systematic, graphic methods of music analysis. In July 2020, Timothy Jackson defended Schenker in the pages of the Journal from an attack by Hunter College Professor Philip Ewell. Professor Ewell labeled Schenker a “racist” and, indeed, the entire tradition of Western classical music as “systemically racist.” This dispute would have remained a typical academic tempest in a teapot, but the University of North Texas swiftly condemned Jackson’s defense of Schenker and classical music. At UNT, defending classical music and its theory against charges of “racism” is a “thought crime.”
Graduate students quickly condemned Professor Jackson for “racist actions” and various other derelictions that they claimed hurt their feelings. Calls for Professor Jackson to be fired quickly escalated, and the vast majority of Jackson’s fellow faculty members jumped on the bandwagon. Sixteen of them signed a graduate student petition calling for his ouster and for censorship of the Journal. Discovery revealed that at least one did so without even reading or understanding what the petition said.
The most important thing at the University of North Texas was to demonstrate pious commitment to “anti-Racism,” no matter how irrational or lacking in substance–or contrary to evidence. As the Dean of the College of Music admitted in open court, the Journal was “put on ice.”
In July 2020, Professor Jackson stood alone against this tide. Had the case been allowed to proceed after Mazzant’s strong decision on the motion to dismiss, the Journal would likely be back in publication by now. Yet censorship is so important at the University of North Texas that the state exercised its right to a special appeal in order to halt discovery in its tracks.

The ruling is a clear warning to do-nothing boards of trustees and boards of regents that they have an affirmative duty to ensure that public universities uphold constitutional rights in education. From now on, they will also enjoy a no qualified immunity from personal suit, at least in the Fifth Circuit. UNT’s Board of Regents had direct governing authority over all UNT officials. They too can therefore be held accountable under the Ex Parte Young for sitting idly by while career university bureaucrats trampled Professor Jackson’s free speech.
Unfortunately, the federal government continues its misguided attempts to control an industry regulators know little to nothing about. But today’s attempts tend to focus more on something they understand even less than trucking: technology.
The electronic logging device (ELD) has been around since the late 1980s. The devices were first adopted by large nationwide fleets to simplify managing their plethora of drivers, and eventually became a way to lower insurance costs. Manufacturers and employers claimed the devices prevented drivers from driving longer than legally allowed, therefore reducing the number of tractor-trailer-related crashes. It was under the latter premise that the DOT mandated that all trucks be equipped with ELDs no later than the end of 2017. Unfortunately, fatal accidents involving tractor-trailers have seen a recent increase following a sharp decline. This correlation suggests that mandating ELDs has not had the promised or intended safety improvements.
More recently, environmental regulations requiring manufacturers to reduce emissions gave us the diesel particulate filter (DPF), an exhaust treatment system that replaces a standard muffler. While there is no current federal mandate requiring a DPF, the filters are required by the 2008 California Statewide Truck and Bus Rule, which has incentivized many nationwide fleets to adopt them. The problem with DPFs is the filter system clogs. A lot.
When DPFs go down, trucks roll to a stop. Truckers report having to have a DPF serviced as often as every 5,000 miles, which means lots of lost productivity and stranded cargo. I’ve had four breakdowns over the past two years, and three were due to my DPF. A tow truck driver I spoke to on one of those occasions told me half of his business comes from malfunctioning DPFs. Repairs are a specialized affair, and replacements can cost up to $2,000. When my truck isn’t moving, I’m not earning. And these regulators have required that my truck stand still far too often.
Next up on the government’s list of ways to make truckers’ lives miserable are proposed speed limiters. Pete Buttigieg, the Secretary of Transportation, wants to limit all tractor-trailers to the same speed. Imagine being stuck behind a pair of tractor trailers side by side, who can’t speed up to pass each other. It’s relatively rare right now, but it will become the norm. Every single interstate nationwide will be populated by moving roadblocks, inspiring road rage and blocking critical services. What happens when the fire truck or ambulance is stuck behind these unbreakable pairs?
Also in the California “Hall of Ls,” after ruing its own police department through defunding, San Francisco is trying to hire cops in Texas.
San Francisco slashed its police department’s budget by $120 million in 2020. Almost immediately, crime rose in the city. Crime has gotten so bad in San Francisco, that residents are reportedly leaving their car doors unlocked, so crooks won’t smash their windows.
Mayor London Breed promised to reverse her “defund” policy by restoring and increasing the police budget. However, the city is struggling to recruit qualified officers. Recently, the San Francisco Deputy Sheriff’s Association accused the mayor of continuing to make cuts to the sheriff’s department.
Despite this, the city went to four universities in Texas to recruit police officers. This appears to be the first time San Francisco looked for candidates outside of California.
Those four universities are Texas Southern University, Sam Houston State University, Prairie View A&M University, and Texas A&M University.

It’s easy to get discouraged over the obscene metastasis of creeping social justice infecting our institutions. Even though only something like 15% of Americans back radical leftwing social justice, it often gives the impression of moving from victory to victory.
But it’s important to note that forces of American liberty have won important victories against the woke Borg. Indeed, the good guys have recently taken scalps in the realm of higher education, and those victories are worth noting.
proactive alumni group working to curb diversity, equity and inclusion at the Virginia Military Institute has been given credit for prompting the school’s DEI chief to quit.
An article in The Washington Post largely cites the actions of proactive alumni, most notably members of “The Spirit of VMI” group, for the decision by Jamica Love to leave her post.
“Love, 49, who leaves her position at the end of June, was the highest-ranking Black woman at the nation’s oldest state-supported military college. But she faced intense backlash from some alumni and cadets as soon as her hiring was announced in May 2021,” the Post reported June 1.
While the Post’s article suggested the dislike of DEI at VMI is due to disgruntled white male alumni, former students there have told The College Fix in recent years they seek to preserve honor and meritocracy at the institute in the face of equity programming. They also said they reject the argument the institute is steeped in racism and sexism.
As The College Fix previously reported, the controversy dates back to a 2021 consultants report that accused VMI of “institutional racism and sexism” and recommended the implementation of new DEI measures.
Last year alumni began actively writing to state lawmakers about their concerns, including Gov. Glenn Younking, as well as voice complaints on social media.
Earlier this year, alumni said they will withhold donations as VMI implements DEI programming.
Texas A&M University has been at the focus of a media firestorm this past month after the school walked back the terms of a job offer extended to journalism professor Dr. Kathleen McElroy.
The saga began with the publication of a story by Valerie Munoz, a Texas A&M journalism student, in Texas Scorecard that highlighted the school’s recent decision to hire McElroy as the new department head overseeing the school of journalism. The university offered McElroy tenured status similar to her present faculty position at the University of Texas.
The story pointed to McElroy’s advocacy for Diversity, Equity, and Inclusion (DEI) measures in both academic settings and newsrooms, drawing a contrast between the journalism professor’s approach to education and new state public policy measures passed by the Texas Legislature this year banning DEI offices in public universities.
In addition, the story reported on a statement by McElroy on her approach to journalism, that she opposes the equal representation of all sides of an issue in news reporting if one side is deemed “illegitimate.”
After the story broke, the university began walking back elements of the job offer, causing McElroy to decide to take the details public.
In an interview with the Texas Tribune, McElroy, who is black, stated she felt she was being “judged by race” and maybe gender after the school decided to rescind the tenure offer and instead offer a one-year contract and at-will employment terms. She said she didn’t believe other people would face the same bars or challenges and that she felt “damaged” by the entire process.
The story has since snowballed into national headlines, and outrage over the hiring process has resulted in the resignation of both the university’s interim dean of the College of Arts and Sciences Jose Luis Bermudez and President Katherine Banks.
If Bermudez and Banks are backers of social justice, and it very much appears they were, their departures (and scalps) are also welcome.
The Texas A&M Faculty Senate recently voted to create a fact-finding committee to investigate the circumstances surrounding the alteration of the job offer extended to McElroy. Shortly after that, Banks tendered her resignation to Chancellor John Sharp, writing that the mass negative press on the incident led to the decision.
“The recent challenges regarding Dr. McElroy have made it clear to me that I must retire immediately. The negative press is a distraction from the wonderful work being done here,” Banks wrote.
Numerous reports placed blame on “outside groups” improperly influencing hiring decisions at the school, a claim reportedly started by the faculty senate. That turned attention to one organization of former Aggies in particular, The Rudder Association (TRA).
According to its website, TRA is “a group of dedicated Aggies committed to preserving and perpetuating the core values and unique spirit” of the university.
In a series of press statements on the group’s website, TRA pushed back on reports characterizing its members, which includes taxpayers, tuition payers, and donors to the school, as “outside influence.” In addition, the group said that university regents and elected officials should not be characterized as such either.
Firing by firing, progress is made.

There are conflicting reports on whether Texas A&M, as ordered by Governor Greg Abbott, are actually ending their raidcal leftwing Diversity, Equity, and Inclusion (DEI, AKA critical race theory, AKA social justice), or just pretending.
The Texas A&M University System has moved to remove all Diversity, Equity, and Inclusion (DEI) statements from their employment and admissions practices, it said in a statement on its website.
Chancellor John Sharp stated that after receiving a letter in February from Gov. Greg Abbott’s office, he ordered a review of all DEI policies in the university system.
“No university or agency in the A&M System will admit any student, nor hire any employee based on any factor other than merit,” said Sharp.
A directive was sent to all university system agencies to limit employment and admissions to a cover letter, curriculum vitae, statements about research and teaching philosophies, and professional references.
A memo obtained from Abbott’s office asserted that DEI policy “has been manipulated to push policies that expressly favor some demographic groups to the detriment of others.”
The University of Texas (UT) System board chairman Kevin Eltife announced a pause on all DEI efforts during a board of regents meeting last week. The move was prompted by his comments about how “certain DEI efforts have strayed from the original intent.”
Is there a reason to doubt the sincerity of this effort? Well, John Sharp is a Democrat, albeit one from an era (he was State Comptroller from 1991 through 1999) where there was still a conservative (or at least moderate) wing to the Texas Democratic Party.
“How Texas A&M Went Woke,” my report from the Claremont Institute, has prompted the Texas A&M administration to respond. First, A&M has reportedly hired someone to continue the process of scrubbing Diversity, Equity, and Inclusion (DEI) policies from its website. Second, A&M is circulating a memo charging that “misinformation” lies at “the foundation of the report.” A&M compares more than a dozen “Statements from Yenor” against “Facts from Texas A&M University.” But their “facts” are simply the evasions and obfuscations of a guilty party. Their rebuttal presents an object lesson in sophistry.
One category of sophistry is refuting a charge not made. I contend that that A&M “has more DEI administrators than UT-Austin.” A&M responds that a comparison of “executive-level DEI operations” in central administration shows that A&M has fewer. I say A&M has more total DEI administrators; A&M says it has fewer central administrators. Both statements are true. A&M had many more lower-level DEI officials than UT at the time of the counting. I say that A&M created a diversity committee to consider removing statues on campus; A&M responds that no statues have been removed (yet!). Again, both statements are true. A&M has not refuted anything I said.
Sometimes, they claim ignorance; A&M evidently has so many DEI programs that it can hardly keep track of them. One is the LEAD program, which trains department chairs in DEI ideology, among other things. A&M is “not aware of a training for department chairs called LEAD.” A snapshot from ADVANCE, the university’s faculty affairs website, shows that this program still exists under a different name.
Another technique is to deny, deny, deny. A&M administrators describe their own ACES program, which is housed in the Office of Diversity. A&M often lauds ACES as a premier diversity program. It lists ACES in its evaluations of diversity programs. A&M now denies that ACES is “a diversity effort.” Who you gonna believe—A&M or your lying eyes?
Sometimes A&M concedes that their DEI programs exist, but that they have discontinued them or that they will discontinue them.

The university has announced in advance how it will get around the A&M system’s recently-announced ban on DEI statements.
The legislature should defund DEI administrative offices in all Texas universities and colleges. All who are currently employed in such offices should be let go. This will make it clear that DEI is bad for one’s career in Texas higher ed. Second, the Texas legislature should adopt the Kalven Report as a vision for university professionalism. Politicized teaching and disciplines should be judged against the standards of the Kalven Report. If disciplines are so thoroughly infused with DEI ideology or any other leftist activism, the legislature should cease to fund them. Disciplines with DEI inscribed into their DNA should not receive public funds.
Most importantly, the Board of Regents must take its job more seriously. It must issue directives to eradicate DEI from universities and then follow through with them by firing university presidents who openly defy the Board or obfuscate their DEI efforts. Personnel is policy. The Left has clamored for DEI practices for generations, and university presidents have responded by permitting the DEI bureaucracy to bloat. It is time for these university presidents to fear conservatives in the legislature more than they do the Left, and this can be done only when select university presidents are fired. If this Board of Regents will not do it, then it too must be released and replaced.
I share Yenor’s skepticism. Those infected with social justice never give up pushing their radical ideology, administration directive or no administration directive. Laying off all DEI personnel is the only way to purge the infection.
Via Texas Scorecard comes two different stories of how radical racist social justice warrior ideology in the form of Diversity, Equity and Inclusion continues to infect Texas universities.
First up: A University of Texas professor is suing UT officials for violating his First Amendment rights.
In attempts to silence the professor for speaking out on controversial issues, university administration threatened his job, pay, institute affiliation, research opportunities, and academic freedom.
Richard Lowery, Ph.D., a tenured finance professor at University of Texas at Austin McCombs School of Business, said in the complaint, “The officials at the state’s flagship university violated his constitutional right to criticize government officials.”
In the suit, Lowery claims the university administration “harmed his right to academic freedom.”
Lowery’s suit explains that the First Amendment “protects the right of public university professors to engage their colleagues and administrators in debate and discussion concerning academic matters, including what should be taught and the school’s ideological direction and balance.”
According to the Institute for Free Speech, Professor Lowery is “well known” for his “vigorous commentary on university affairs.” Lowery’s articles have been featured in The Hill, The Texas Tribune, the Houston Chronicle, and The College Fix.
Lowery has also been known to use social media and online opinion articles to “publicly criticize university officials’ actions, and ask elected state-government officials to intervene. He has also used such tools to participate in the sort of academic campus discourse that faculty traditionally pursue.”
In his articles criticizing UT officials, Lowery specifically calls them out for their approaches on issues such as “critical race theory indoctrination, affirmative action, academic freedom, competence-based performance measures, and the future of capitalism.”
On multiple occasions, Lowery reported that university administrators are using diversity, equity, and inclusion (DEI) requirements to filter out “competent” teachers and professors who disagree with the DEI ideology prevailing on campus.
In response, Lowery claims university administrators “responded with a campaign to silence” him, where they threatened his job, pay, institute affiliation, research opportunities, academic freedom, and labeled his behavior as inviting violence or lacking in civility.
The suit continues, saying school officials “also allowed, or at least did not retract, a UT employee’s request that police surveil Lowery’s speech, because he might contact politicians or other influential people.”
“Lowery got the message,” the suit says.
In response, the professor is seeking to “vindicate” his right of free speech, asking the court to declare the administration’s actions as unconstitutional and restore his First Amendment rights to speak on matters he was previously prevented from speaking on.
DEI has even infected the university previously considered a bulwark of conservative value, Texas A&M:
Thought of by many Texans as a relatively conservative university, a new report explains how Texas A&M has “gone woke” in recent years.
Scott Yenor, a Boise State professor and fellow at the Claremont Institute, explained during a recent interview on The Luke Macias Show how leftist Diversity, Equity, and Inclusion (DEI) policies have seeped into the campus.
DEI programs have come under fire recently for prioritizing factors like race, gender, and sexual orientation over merit in hiring, admission, and curriculum.
“Texas A&M has this reputation as being one of the more conservative public universities. I know a generation ago when someone asked me where I would send my kids to school, I said the best public university in the country is Texas A&M,” said Yenor.
But when Yenor began researching DEI programs in college campuses across the country, he found something troubling in Texas.
The interesting thing about these universities is that they advertise what they’re doing. They have a plan and they’re proud of the plan. And then they go about trying to execute the plan. And Texas A&M announced a very radical diversity plan in 2010 and has been executing it like on steroids the last two years.
Yenor mentioned recent efforts to take down a statue of former Confederate General and Texas Governor Sul Ross from campus. Though that movement was unsuccessful, Yenoer argued bigger factors are at play.
“There were attempts to take down statues and, and, you know, other other ways of affecting the campus climate symbolically. But the more important thing is that there’s been a real, real ratcheting up of their understanding of what they have to do. The 2020 diversity plan really concerns breaking down the systems of oppression in words like ‘merit,’ hiring the best person, and things like that,” said Yenor.
To that end, Yenor pointed out a shocking statistic: Texas A&M University currently has more DEI personnel than the University of Texas at Austin.
“It’s true at A&M that diversity is the new merit,” said Yenor.
Governor Greg Abbott issuing a directive banning the teaching of Critical Race Theory doesn’t seem to discouraged social justice warriors from continuing to radicalize Texas higher education. There needs to be sterner measures, including defunding the DEI bureaucracy, followed by pink slips.
