I have never seen numbers this bad for an incumbent president during my lifetime … These numbers looked NOTHING like this in 2020. These numbers were bad already … they have gotten considerably worse even in just a few days after that first presidential debate.
How bad is Biden doing? This should come with the standard Instapundit “don’t get cocky” disclaimer, as well as a disclaimer that I haven’t examined this guy’s methodology and model at all, but even if the margins are half what he’s saying, it’s still really, really bad for Biden.
As in “Biden is winning Illinois…by three points” bad. New York is within striking distance for Trump. And right now he’s even edging Biden in New Jersey. (Hat tip: Ace of Spades HQ.)
Biden says that no one is pushing him out of the race, though even Lightbringer McLegTingle himself has reportedly joined the chorus of concern over Slow Joe’s debate meltdown.
According to ‘several people familiar with his remarks,’ and perhaps most notably conveyed via the Washington Post, not only has Obama grown more concerned following the debate (and having to physically guide the 81-year-old off of a stage last month), the former president “has long harbored worries about his party defeating Donald Trump in November, repeatedly warning Biden in recent months about how challenging it will be to win reelection.”
Not only that, “Just before the debate, Obama conveyed to allies his concerns about the state of the race.”
So Obama gets to save face, while adding to the growing chorus of Democrats who have expressed everything from quiet panic to public hints, to outright calls for Biden to drop out of the race.
Usual “sources close to” caveats apply.
The mainstream media is shocked, shocked that Democrats lied about Biden’s cognitive decline as they actively aided and abetted them.

Democrats decided to shut Joe Biden down for a week. Not because they wanted to, but because they figured they had to. It was the only chance Biden had — thin as it turned out to be — to get through a 90-minute session in which he’d be asked questions he couldn’t answer with note cards, in which he’d be challenged vigorously and need to be quick on his shuffling feet.
Here’s the thing, though. What we saw on Thursday night was the result of that week of preparation and rest. And it was a disaster. So . . . what must the prep have been like?
Biden’s closest aides and the top Democrats with whom they are in constant communication know better than anyone in America that the president cannot function, that he cannot do the job. Yet, rather than ease Biden out, invoke the 25th Amendment if he wouldn’t go voluntarily, and ensconce in the Oval Office the vice president they insisted in 2020 would be ready to take over if the octogenarian collapsed, they decided they had to try to drag Biden across the finish line.
Why?
Because the Democratic Party is a trainwreck.
As catastrophic as Biden is in his senescence, he remains useful cover for the fact that the youth, energy, and money in the Democratic Party is woke-leftist, Islamist, counter-constitutionalist, post-American, and unelectable.
This doesn’t mean the whole Democratic Party is that way. But it does mean that sensible Democrats have to mind their tongues and genuflect in the crazies’ direction if they want to remain viable. They may personally believe, like the majority of Americans believe, that the border needs to be secure; that we can’t allow millions of illegal aliens a year to enter the country; that we don’t want boys and men invading the formerly safe spaces of girls and women; that mere statistical racial disparities in outcomes do not establish racism; that crime — especially recidivist crime — is a serious problem; that we need to back Israel’s wars against Hamas, Hezbollah, and their Iranian patrons; that a radical “green energy” transition the country is not ready for weighs too heavily on the budgets of everyday Americans even as it drives the national economy deeper into the ditch; and that America, warts and all, is fundamentally good — rightly, the envy of the world. But woe betide the Democrat who gives voice to such commonsense views.
Democrats have thus rolled the dice with Biden, and with the nation’s security, because the alternative is dealing with that rift.
Joe Biden is a lifelong mediocrity. But he has the fortuity of being both a Democrat from another era and Obama’s vice president. Because he’s a doddering blank slate, Democrats of all camps could project onto him their kind of Democrat. He could run in 2020 as the guy who could face down the radicals, and then govern under the thumb of the radicals — but with enough rhetorical feints to the old establishment Dems that they might yet rally around him . . . especially with no alternatives except the hard left and Donald Trump.
Why Joe Biden? Because Democrats want to stay in power and propping him up, as impossible as that has now become, seemed to be the best plan. Sadly, it may yet be.
Unemployment is at a three year high. And those are just the official figures. The truth is probably far worse.
Rigging the 2020 election through Zuckerbucks. “(a) tax-exempt non-profits are prohibited by federal law from engaging in partisan political activity, and (b) the Zuckerberg-funded ‘cabal’ had no other purpose except to guarantee Biden’s election.” And it did this through get-out-the-vote efforts exclusively in heavily Democratic precincts.

Israel may be in a “settle all family business” sort of mood…
“National Education Association members will vote on several anti-Israel resolutions at the union’s annual ‘Representative Assembly’ in Philadelphia this week, including the adoption of an official position holding that Israel is conducting a ‘genocide’ in Gaza and that opposing the Jewish state’s existence is not antisemitic.” I’m sure they’d rather focus on Gaza than undertake radical courses of action like teaching kids to read.
Six years after California legalized marijuana, the bodies keep piling up. Earlier this year, six men were murdered in the Mojave Desert. Four of the men had been burned after being shot with rifles. In 2020, seven people were killed at an illegal pot operation in Riverside County.
Violence like this was supposed to disappear after legalization. Legalization advocates argued that making the drug trade legal would end the grip of the cartels. Instead, the legal market has failed, and the cartels are taking over sizable parts of California and the rest of the country.
California’s legal drug revenues have fallen consistently, as have those in other legal drug states including Colorado, whose model helped sell the idea that drug money would fix everything.
Despite falling revenues, Colorado legislators brag about $282 million in drug revenue. That number may sound high, but it’s a drop in the bucket considering the money that the state and cities like Denver are spending on homelessness, drug overdoses and law enforcement.
While the legal drug business is also collapsing in California, the state is spending a fortune fighting marijuana even as it tries to tax it. Gov. Gavin Newsom paradoxically promised to close the budget deficit with $100 million in drug revenue, meant to be used to fund law enforcement and fight substance abuse. The state seized over $300 million in illegal pot this year and uses satellite imagery and heavily-armed raids to fight untaxed marijuana.
But despite all those efforts, illegal marijuana has won and legal marijuana has lost.
The Los Angeles Times warned two years ago:
“Proposition 64, California’s 2016 landmark cannabis initiative, sold voters on the promise a legal market would cripple the drug’s outlaw trade, with its associated violence and environmental wreckage.
“Instead, a Los Angeles Times investigation finds, the law triggered a surge in illegal cannabis on a scale California has never before witnessed.
“Rogue cultivation centers like Mount Shasta Vista now engulf rural communities scattered across the state, as far afield as the Mojave Desert, the steep mountains on the North Coast, and the high desert and timberlands of the Sierra Nevada.
“Residents in these places describe living in fear next to heavily armed camps…”
Some of the growers are private citizens, but they aren’t likely to remain in business for long.
Cartels and gang members dominate the business. And open borders allowed them to bring massive numbers of laborers to boost their ranks. Not only California, but places as far afield as Maine that have large open areas and limited law enforcement resources, have been overrun by drug operations that more closely resemble parts of Latin America and Asia than the USA.
The coasts, from Southern California up to Oregon, are controlled by Mexican cartels which have expanded so much that they’re running short of workers even during the Biden open borders boom. Some have taken to brazenly advertising for illegal workers in Europe.
A local California DA described “Mexican cartel groups coming up to grow pot, and people from Bulgaria, France and Russia.” The vast exodus across the border has made it possible for cartels to freely bring in any workers they want, even as drug legalization and open borders effectively ended any real penalties for either illegal migration or marijuana.
Asian organized crime may be less on the radar, but it is no less ruthless or violent.
A few years ago, four Chinese people were murdered at an Oklahoma illegal pot farm. Chinese organized crime had “taken over marijuana in Oklahoma and the United States,” the head of the Oklahoma Bureau of Narcotics and Dangerous Drugs revealed.
Once again, “the mafias set their sights on Oklahoma when the state’s voters approved a ballot measure that legalized the cultivation and sale of marijuana for medicinal purposes.” Now the Triads run their own compounds “ringed by fences, surveillance cameras and guards with guns and machetes” with 3,000 illegal grows having a value estimated at as high as $44 billion a year.
The Triads are not just in the illegal marijuana business, they traffic in everything from heroin to fentanyl. Legalizing marijuana, however, provided them with a profitable and semi-legal market that gives them a base to expand their efforts trafficking in even more lethal drugs.
Drug legalization has failed on every level. The legal drug business is collapsing. MedMen, which once promised to be the Apple of weed, fell from a $3 billion valuation to a bankruptcy with $411 million in liabilities. Despite the green crosses and online apps, 80% of Californian’s pot is still the old-fashioned illegal kind. Politicians may be boasting about hundreds of millions in revenue, but the cartels are making tens of billions and they’re taking over entire forests.
The future isn’t pot shops, weed apps or MedMen: it’s Mexican and Chinese organized crime compounds that are spreading across the West and parts of New England like a plague.
Also in California, State Farm is jacking home owners insurance into the stratosphere.
State Farm requested massive increases to its California residential insurance rates, which calls its financial stability into doubt amid an ongoing crisis in the state’s insurance market.
The company’s California subsidiary, State Farm General, the state’s largest writer of homeowners insurance, according to the Insurance Information Institute, submitted a request on Thursday to the California Department of Insurance for the following rate hikes:
30% increase in homeowners insurance
336% increase in condominium owners insurance
352% increase in renters insurance
With California’s property insurance market already facing an availability and affordability crisis, driven largely by rising wildfire risk, the timing could hardly be worse.

The Supreme Court of the United States (SCOTUS) has ruled unanimously in a case involving a 2021 Texas social media transparency law, sending it back to the U.S. 5th Circuit Court of Appeals.
House Bill (HB) 20, which requires major social media platforms to be more transparent and prohibit viewpoint-based censorship, passed in the 87th Legislature. It faced an immediate legal challenge, resulting in a temporary block by a federal district court. This decision was appealed to the 5th Circuit, which temporarily lifted the block, allowing the law to take effect.
Justice Elena Kagan delivered the opinion for SCOTUS, writing, “Texas has never been shy, and always been consistent, about its interest: The objective is to correct the mix of viewpoints that major platforms present. But a State may not interfere with private actors’ speech to advance its own vision of ideological balance.”
So the Supreme Court will not save Americans from big tech companies teaming up with secret government entities to impose censorship on their platforms. Americans will have to do that for themselves.
The Tories got slaughtered in Rishi Sunak’s spectacularly ill-advised snap election, handing Labour, which seemed on life-support just a few years earlier, a 170 seat majority. “Labour got 3 times as many seats, but did not win – the Conservatives lost, and lost badly, punished by the electorate. Reform were the real winners – although they only got 4 seats.” Sir Keir Rodney Starmer KCB KC will now become Prime Minister, Sunak is going to go down as one of the Tories worst leaders, and Nigel Farage will finally sit in parliament. Will Labour take this as a greenlight to go full speed ahead on unlimited immigration and hard green NetZero? I wouldn’t put it past them.
Belarus does more sabre rattling on the Ukraine border. I suspect this is just a feint to tie up Ukrainian units on the border, as Putin puppet Aleksander Lukashenko might face a real revolt from his military if he tried to send units into Ukraine.
Remember all that panic over investors buying up housing? Thanks to the Biden Recession, they’re now unloading them at firesale prices. “It’s impossible to make money on mortgage properties with interest rates where they are today.” Well, unless they took out fixed rate mortgages, which real estate companies are evidently loath to do. “Inventory [in this Florida zip code] has gone up 800 to 900%.”
So I thought about doing a post on this Chinese-constructed, Malaysia-based, eco-themed Forest City ghost city just outside Singapore, with the obvious “post apocalyptic” slant, but one thing stopped me: It actually looks kinda cool and well-maintained, and if the usual shoddy tofu dregs building processes have been used, they’re not apparent in this brief tour. Everything looks classy and expensive. And for once, you can’t entirely blame the CCP for the debacle, since the Malaysian government evidently changed foreign ownership rules after most of it had been constructed.
This is a weird story: “Walter Ringfield Jr., the 27-year-old Phoenix resident charged with stealing keys to voting equipment from Maricopa County elections headquarters, has a history of theft allegations – and an apparent interest in running for public office.” He stole keys to a tabulating machine that couldn’t be used without access to other keys he didn’t have for a job he was temping at. Could be a another Democratic attempt at election fraud, or the guy just might be a klepto.
Michigan lawmakers want to make the AR-15 the official state gun. Nice. Texas already has a state gun, the Colt Walker pistol, which is pretty important historically. Tennessee’s official state gun is the Barrett M82, which I think wins the firepower crown, until someone names the Ma Deuce the offical state gun…
You probably remember Scott of Kentucky Ballistics’ little oopsie (as he calls it), when a spicy round blew up his 50 cal and almost killed him. Since that brush with death he’s deliberately blown other firearms under more controlled conditions and filmed the results to show the failure modes.
This time, however, he’s teamed up with The Slow-Mo Guys to blow up some guns at exceptionally high frame rates.
They blow up both an AR-15 and a .300 Winchester Mangnum rifle. The most interesting part for me was seeing that the explosion rips through the bottom of the AR’s magazine before the top of the gun starts flying.

September background checks for firearms conducted by the FBI were at the lowest in 22 months, suggesting the year and a half of panic buying guns has lost momentum.
FBI’s National Instant Criminal Background Check System (NICS) data shows background checks slumped 9.2% in September from a year ago. Unadjusted checks dropped to 2.63 million when compared with last September.
I sure hope so, because I would like to buy me some more guns. In particular, I’ve held off buying an AR-pattern rifle because prices got way crazy last year. Maybe I can finally pick up Smith & Wesson M&P15 in 5.56 NATO/.223 if they drop back to the $550-600 price range. (And not one of the crappy “legal for California” versions with the fixed magazine.)

The Indictment of Hillary Clinton campaign lawyer Michael Sussman for allegedly lying to the FBI has a lot of people grumbling about how long it took prosecutor John Durham to finally come up with an indictment of someone with regard to the Russia collusion hoax. And even then, while Sussman was an important lawyer at an important Democrat operative law firm, his indictment has a “that’s it?” feel to it.
But, the 27-page Indictment is a wealth of information, and hopefully a roadmap to wider and more substantial prosecutions (you can’t take my hope away!). What the indictment demonstrates is that the Russia collusion claim leveled against Donald Trump and the Trump campaign was a fabrication of Hillary Clinton operatives who peddled the fraud to the media and FBI, allowing Clinton to use the media reports in the campaign against Trump.
Much like the fabricated Steele Dossier, also paid for and arranged by Clinton operatives, Hillary Clinton and Clintonworld perpetrated a massive fraud on the American public which not only manipulated the election process but also froze the Trump presidency and nearly paralyzed the nation politically for years.
We have had some pretty terrible politicians in our lifetime, and it’s always dangerous to say “the worst” — but the Russia collusion hoax fabricated by Hillary Clinton operatives proves beyond little doubt that Hillary Clinton is the most systemically manipulative politician of our lifetime.
Forget the MSM spin: Here’s what the Maricopa County audit really found:
None of the various systems related to elections had numbers that would balance and agree with each other. In some cases, these differences were significant.
There appears to be many ballots cast from individuals who had moved prior to the election.
Files were missing from the Election Management System (EMS) Server.
Ballot images on the EMS were corrupt or missing.
Logs appeared to be intentionally rolled over, and all the data in the database related to the 2020 General Election had been fully cleared.
On the ballot side, batches were not always clearly delineated, duplicated ballots were missing the required serial numbers, originals were duplicated more than once, and the Auditors were never provided Chain‐of‐ Custody documentation for the ballots for the time‐period prior to the ballot’s movement into the Auditors’ care. This all increased the complexity and difficulty in properly auditing the results; and added ambiguity into the final conclusions.
That’s the thing about a Missing White Woman story — the damsel-in-distress angle only works, in terms of TV news ratings, if the missing woman is young and attractive, preferably blonde. Males can and do go missing, but those disappearances never dominate national news. It’s always a woman, and a young, attractive woman — if she’s old, fat or ugly, nobody cares if she goes missing. But the nubile blonde? Oh, yeah, that’s nationwide headline stuff, because she’s Prime Rape Bait, and sex is the secret ingredient in the Missing White Woman story.
Beyond the cynical calculations of ratings-hungry TV news producers, however, what’s really wrong with Missing White Woman Syndrome is not the kind of “social justice” concerns Joy Reid is talking about. No, what’s wrong is that it feeds the public’s distorted ideas about crime.
How many people are murdered in America annually? Nearly 14,000 in 2019, according to the FBI, and about 78% of the victims were male. In terms of statistical risk, then, males were nearly four times more likely to be murdered than women, but how many of those murdered men become national news? Not many. And how many murder victims are white? About 5,800 in 2019 — 42% of the total — whereas blacks were 54% of the total murders. There were 1,759 white women murdered in 2019 — 12.6% of the total, according to the FBI — compared to 6,446 black males, 46.3% of the total. So the death of Gabby Petito was anomalous, a comparative rarity in the overall crime situation in America.
A blonde, blue-eyed “social media influencer” is not typical of murder victims, who are disproportionately male and black. During the month of August, when Gabby and her boyfriend were on their excursion across the West, 87 people were killed and 424 were wounded in Chicago. Did any of those Chicago victims make national news? Well, about 83% of the victims in Chicago were black, and none were blonde, blue-eyed 22-year-old “social media influencers.” Not newsworthy, you see?
The selectivity of the news media in deciding which murders deserve national attention is a sort of bias that most people never notice. Why does the death of one black in police custody become a cause célèbre, while the vast majority of murdered black men — about 125 a week, on average — never get any national media attention? Because the death of George Floyd fit a specific political narrative. And why does the disappearance of a blonde girl with an Instagram account get hourly updates on the cable-news networks? Because it’s a convenient distraction from the disastrous failure of Joe Biden’s presidency.
In fact, there were at least 46 reports of swollen balls (and another 76 of testicular pain) in the VAERS database of adverse reactions.
People who wanted Biden to win to see a “return to normal” are being gravely disappointed:
In traditional Washington fashion, Biden has ignored that message voters sent and delivered the opposite. In less than seven months, we have found that Biden is far from that empathetic persona he has crafted over the years, and we have not returned to anything near normal.
And Biden lies. Not tiny little lies, but ones that affect events that are deeply tragic. Last week, he told leaders in the Jewish community that he visited the Tree of Life Synagogue in Pittsburgh, where 11 people were slaughtered during a service in 2018.
Synagogue officials said he was never there.
One can only guess he said this as an attempt to continue the manufactured empathy he allegedly possesses. Forgetfulness is not an excuse anyone should accept.
Nor is it normal.
In fact, the only thing the Biden presidency has done most effectively is prove that we are not on the path to normality under his administration.
From the uneven overall economy to soaring inflation to the humiliating debacle in Afghanistan, and from Biden’s insistence to spend our money like a drunken sailor to the crisis at the Mexican border that he has blatantly ignored and to how he has politicized the pandemic: None of this is normal, none of this promotes stability, none of this is what an exhausted electorate bargained for.

Alexandria Ocasio Cortez’s gambit to have funding for Israel’s Iron Dome missile defense system stripped backfires, with the funding passing 420-9. Now there’s principled case to be made against the U.S. funding Iron Dome, as part of a broader initiative to eliminate all foreign aid because it’s not an enumerated responsibility of the federal government, because we’re already running huge budget deficits, and because Israel is a prosperous, modern country that shouldn’t need our charity. But we all know that not why The Squad presented this bill.
I think the Squad’s biggest problem with the Iron Dome is that it keeps people from killing Jews.

Our current moment is often described as a “racial reckoning.” In reality, what this often means is that a narrative about Black victimization has gone mainstream. We hear endlessly about systemic racism, white supremacy, the black/white income gap, and police brutality. So powerful an ideology has this narrative become that those of us who pose a credible counter-narrative—black anti-woke writers, for example—frequently find our words being misconstrued in an effort to stanch their impact.
This doesn’t happen to everyone who opposes the Critical Social Justice narrative of black victimization. White dissenters are simply called “racist” while many black dissenters are considered tragic victims of internalized racism. But things get ugly when woke Critical Social Justice proponents encounter a certain kind of black person who does not align with their preferred victim narrative and instead emphasizes his or her own individuality or self-regard. Such people present a threat to the woke narrative, since that narrative insists that all black people are victims of white supremacy, meaning anyone who insists on their individuality and their own power proves the falsity of that victim narrative; if the woke narrative were true, such people should not be able to exist.
Which means that when we claim to exist, antiracist woke warriors need to erase us, using a logical fallacy I call “erase and replace.” Erase and replace is a combination of the strawman and ad hominem logical fallacies. The move involves taking the argument someone is making and substituting it for one that fits more neatly into the woke victim narrative by specifically targeting the character of the challenger—since it is, in part, their character that is the greatest challenge.

In New York, I believe such an offense would fall under the statute for “forcible touching,” which is a class A misdemeanor. Do you think that this is coming out now because, with his brother out of office, Fredo is no longer of any particular political use to CNN?

The White House is planning to withdraw David Chipman’s nomination to run the Bureau of Alcohol, Tobacco, Firearms and Explosives this week amid bipartisan pushback over his gun control advocacy, according to two people with knowledge of the decision.
President Biden nominated Chipman, who worked at ATF for more than two decades before joining the gun control group led by former congresswoman Gabrielle Giffords (D-Ariz.), in April.
Gun owners were absolutely opposed to the Chipman nomination from the git-go, not only for Chipman’s gun grabbing proclivities, but also for things like lying about the Branch Davidians shooting down helicopters, wanting to ban the AR-15, and general hostility to both gun owners in specific and conservatives in general.
Gun Owners of America, among many others, strongly opposed the nomination.
The ability to stop Chipman shows that gun owners and Second Amendment advocacy groups in America still have a lot of political power and influence in America, despite the NRA’s self-inflicted wounds.

Senator John Cornyn — a Republican who should be pro-2A — is quietly making a deal with the rabid anti-gunner, Chris Murphy, to pass universal background checks.
We need EVERY gun owner in America to take action right now to prevent what would be Armageddon for the Second Amendment.
The language seems overwrought in that direct mail we’re-all-going-to-die-unless-you-donate way. Is there some truth to it? Apparently so:
After years of failed attempts to pass a firearms background check bill, two senators think they have a path to agreement — at least on one key component of a deal.
Sens. Chris Murphy, D-Conn., and John Cornyn, R-Texas, have been quietly negotiating a way to bolster background check rules by making a small but consequential tweak to current law, which they say would close an unintended loophole in the system that has led to preventable mass shootings.
House-passed legislation to require background checks on nearly all gun purchases has stalled in the Senate. But Murphy and Cornyn, who have been negotiating behind closed doors with little fanfare, believe they may have a formula that can attract broad support from both parties.
Bipartisan, of course, means that the Stupid Party and the Evil Party get together to do something stupid and evil. Or, in this case, Republicans go squishy in the face of Democrat demands. The NBC makes it sound innocuous:
Specifically, they want to clarify who is required to register as a federal firearms licensee, or FFL, and thus conduct FBI checks on a buyer before selling a gun. The senators say an ambiguity in the law has enabled unlicensed sellers to transfer weapons to dangerous people who skirt the background check system.
That is, until you realize that Democrats probably want everyone selling even one gun to register for an FFL. Cornyn’s reassurances are…not reassuring.
Cornyn said he’s motivated to close the loophole after it was exploited by the shooter in Odessa, Texas, who couldn’t buy a firearm from a licensed dealer due to mental health problems.
“But then he went to an unlicensed dealer who bought parts and assembled those — but basically was in the business of manufacturing firearms,” he said. “But because he was not a federal firearms licensee — because he was evading that requirement — he didn’t do a background check and this guy got this AR-15 lookalike and killed a lot of innocent people.”
I suspect this is another feint in the Democrats’ battle on 80% lowers, which is part of their campaign to ban all AR-pattern modern sporting rifles, which is a front in their greater war to completely disarm all law-abiding citizens.
Media coverage makes it sounds like there are scores of basement gunsmiths cranking out AR-15s from parts kits and selling them willy-nilly. (And honestly, given the current panic buying, that’s probably not the worst business model out there.) If that were the case, I’m pretty sure current legislation gives the ATF plenty of scope to shut down unlicensed firearms factories. And if they’re not, additional legislation isn’t going to help that goal, but only provides an additional means by which the federal government can ensnare and harass law-abiding citizens.
I’ve asked Senator Cornyn (yesterday via Twitter, today via email) to comment on the report, but thus far I haven’t heard back.
It’s bad enough that Democrats are trying to use their razor-thin legislative majorities to ram through their gun-grabbing legislation without Republicans defecting. No Republican should agree to any changes in gun laws while Democrats are in control.
A federal judge ruled Friday that California’s “assault weapons” ban is unconstitutional.
The court found the state’s ban on the sale of AR-15s and other popular rifles violated the Second Amendment. Judge Roger Benitez [of the United States District Court for the Southern District of California] ruled the guns targeted by California are in common use. He said the state ran afoul of the Constitution in restricting access to them.
“This case is not about extraordinary weapons lying at the outer limits of Second Amendment protection,” Benitez wrote. “The banned ‘assault weapons’ are not bazookas, howitzers, or machineguns. Those arms are dangerous and solely useful for military purposes. Instead, the firearms deemed ‘assault weapons’ are fairly ordinary, popular, modern rifles.
“This is an average case about average guns used in average ways for average purposes.”
California’s ban is one of the oldest and most aggressive in the country. It was instituted in 1989 but has been expanded multiple times in the decades since. The state added more guns and features to the ban. Eventually, it banned the possession of unregistered “assault weapons” before the latest iteration of the ban was challenged by gun-rights groups in federal court.
Benitez said the AR-15’s versatility made it widely popular in the United States, and that popularity is part of what gives it protection under the Second Amendment. He compared the modular firearm to a “Swiss Army Knife” and noted its use for home defense and civil defense.
“Good for both home and battle, the AR-15 is the kind of versatile gun that lies at the intersection of the kinds of firearms protected under District of Columbia v. Heller and United States v. Miller,” he said. “Yet, the State of California makes it a crime to have an AR15 type rifle. Therefore, this Court declares the California statutes to be unconstitutional.”
1989 means the ban even predates the cosmetic Clinton-era “assault weapon” ban intended to ban ARs, AKs, and most modern sporting rifles. Indeed, the Roberti-Roos Assault Weapons Control Act of 1989 was the model the Clinton Administration used for their own ban, including the dreaded barrel shroud. Roberti-Roos is also the source of California’s infamous ban on detachable magazines and those holding more than 10 rounds.
For those that say the Republican Party has been completely useless at achieving conservative objectives, I would point to the appointment of strong Federalist Society and pro-Second Amendment judges as one of many counter examples. Without Reagan and Bush41, we don’t get Scalia and Thomas, and without them we don’t get Heller. Indeed, without originalist judges, the Second Amendment would probably have been legislated away entirely by now…
Vulnerable red- and purple-state Democrats need some bipartisan cover if they’re going to vote for another massive spending bill. And Biden would prefer to have a unified Democratic Party blaming Republicans for the inability to come to a consensus than to have a divided Democratic Party with one side of the Senate caucus blaming the other side of the Senate caucus for the inability to come to a consensus.
Chuck Schumer is largely bluffing when he says the Senate will pass an infrastructure bill in July, with or without Republicans. Democrats can go down this path, but it’s a risk that at least a handful of their senators don’t want to take, and when the Senate is split 50–50, the Democrats can’t afford to lose anyone. Those with long memories can remember when Democrats were convinced all the legislation they passed in 2009 and 2010 would protect them in the midterms.
Speaking of Democrats in trouble, rising violent crime rates are another thing that might doom them in midterm elections:
A rise in violent crime is endangering slim Democratic congressional majorities more than a year out from the midterm elections and threatening to revive “law and order” as a major campaign issue for Republicans for the first time since the 1990s.
Homicides in cities increased by up to 40% over the previous year, the biggest single-year increase since 1960, a trend that has not abated so far in 2021. Sixty-three of the 66 largest police jurisdictions saw a rise in at least one category of violent crime, ranging from homicide and rape to robbery and assault, according to the Major Cities Chiefs Association. Homicides and shootings have gone up for three straight years in Washington, D.C., and at least a dozen mass shootings were reported nationwide over the weekend.
Democrats’ flirtations with defunding the police — a handful of lawmakers on the Left nearly scuttled a $1.9 billion Capitol security bill in the House — may make them ill-equipped to handle the reemergence of crime as a top issue for voters.
Mirrors are useful. A hooker walking down the street can easily fix their makeup. They can lean on them when they nod out too. In addition, when a heroin addict has no more veins left to inject in their arms, that mirror can help them find one in their neck.
It’s kind of hard to inject a needle in your neck otherwise. Think about it.
You’ll eventually get a sideview mirror ripped off your vehicle sooner or later. It generally happens as they nod out or “dip out” when the drugs kick in. When they slump towards the ground, they generally just take the mirror with them.
You also become way to comfortable with people “dipping out”. It’s the local dance craze around here. As heroin takes effect, it’s almost like they fall asleep on their feet — slowly getting ever so close to the ground. Miraculously, they rarely hit the pavement. Many yoga masters couldn’t duplicate their prowess.
Dippers are everywhere. It’s so common, YouTube has endless clips up and down Kensington Avenue; many have hundreds of thousands of views. A YouTuber named “HoodTime” has over 5 million views on a walk he captured through Kensington March of this year. Many others are following suit.
Just walking through Kensington and filming gets you instant material. There’s always something to see here. It’s sometimes hard to tell if you’re in America or a third-world nation at points. But money hides in trash and addiction.
As Mike Newall explains in his article for the Philadelphia Inquirer, some of the drug corners near where I work pull in over $20 million a year. He also quotes Pennsylvania Attorney General Josh Shapiro as saying Kensington’s drug trade is close to a billion dollar a year enterprise.
(Hat tip: Dwight.) There are ways to decriminalize drugs that don’t give a pass to widespread “quality of life” offenses. merely ceasing to prosecute people for open criminality doesn’t make the problems that open criminality engenders go away.
Even Ezra Klein says that rising crime rates are a threat to Democrats. Gee, I must have missed him expressing such concerns when antifa and #BlackLivesMatter were burning down large swathes of American cities last year…
Far too many Republicans, for far too long, have found themselves distracted and/or enslaved by the elite consensus, restrained by norms and conventions that the liberal elite demands we observe, but that it itself flaunts when those rules limit its options. These Fredocons care what people who care nothing about them think, and they find themselves responding to the outside stimuli of the garbage mainstream media instead of focusing intently on conservative change while disregarding the slings and arrows of the haters. When it comes to fighting the establishment, political Asperger’s is indicative of awesomeness.
And our next generation of Republicans needs to embrace their place on the Spectrum – the more inappropriate the liberal elite finds their reactions to its cues and signals, the better. No more tame, pliable sissies like Mitt (R-ish – Miracle Whip). No more of Nikki! Haley’s sucking up to the establishment while trying to grift the base by leveraging hack conserva-cliché’s from 2005 to present to us as hardcore instead of Jeb! in a dress. No more Kristi!s and Asa!s fronting as all tuff about men pretending to be girls to win races then folding the second the establishment disapproves. Instead, we need GOP politicians who are utterly immune to the siren song of a media and an establishment that seek to draw them in and crash them upon the rocks. Our pols need to ignore MSNBCNN and its hysterical horsehockey. They need to stop reading the NYT and WaPo and being scared that a bad write-up will get them uninvited to all the cool parties. They need to lock onto their target and take it out like an Israeli missile flattens a Hamas/AP frat house.
Look at Ron DeSantis – he just doesn’t care what the bad guys say. Not at all. They scream that he won’t enforce face-diapering, that he’s too hard on election fraud, that’s he’s declared open season on those Antifa/BLM nimrods who trap normal citizens in their cars on public roads, and then DeSantis just goes ahead and does what he wants anyway. And it works – he’s super popular.
For the past four years, there was no greater laughingstock in the American foreign policy cognoscenti than Jared Kushner. A full-on consensus reigned that cast the previous administration’s Middle East policies as hopelessly ignorant and one-sided, a view that went unchallenged in the smart set’s Op-Ed pages. There was no easier laugh to be had, no quicker way to pull a nodding agreement, than to mock the intelligence and good will of the former president’s son-in-law, charged with crafting an American peace plan, and obviously in way over his head.
But the Young Pretender in charge of the Mideast portfolio is gone, and the mommies and daddies are back in charge, their think tanks falling over each other producing glossy full-color booklets promoting policies that would bring to bear the priorities of people who actually understood a thing or two about Israelis, Palestinians, international law, justice, and most importantly, American strategic interests.
And four months into the methodical implementation of all the bright ideas reflecting off those glossy booklets, the situation on the ground in Israel and the Palestinian Territories has taken a dramatic turn for the worst.
Though Kushner is long gone, this latest conflagration has been laid at his feet. His name trended on Twitter for days as hostilities between Israel and Hamas escalated. “They really put Jared Kushner, the slumlord millionaire who couldn’t properly fill out security clearance forms, in charge of Peace in the Middle East. Failure was inevitable,” read one viral tweet. “Kushner’s Absurd Peace Plan Has Failed” blared the headline to Michelle Goldberg’s New York Times column.
This is not just wrong; it’s complete projection. Kushner-era policies—on Jerusalem, UNRWA, and regional diplomacy—were promised again and again to lead to an “explosion,” but didn’t. The return of the experts was supposed to improve lives and prospects for Israelis and Palestinians alike, but hasn’t. In fact, it was the foreign policy intelligentsia’s values and vision that have led to disaster.
Back in March, mere weeks into the new Biden administration, a leaked internal State Department memo outlined the contours of a new direction on American policy toward the Palestinian issue. The document called for renewed diplomatic ties with the Palestinian Authority, restoring aid that had been cut, renewing American contributions to UNRWA, putting pressure on Israel for moves in Jerusalem that would make a new Palestinian Authority election possible, and pursuing a two-state arrangement based roughly on the pre-1967 lines.
These were all priorities of the smart set miffed by a previous administration that was too close to Israel for their tastes. But they were also terrible ideas. Take the renewal of UNRWA funding. UNRWA is the U.N. agency dedicated to perpetuating, rather than solving, the Palestinian refugee problem. By cultivating the myth of a non-existent “right of return” rather than rehabilitating displaced persons and their descendants, UNRWA ensures that a negotiated two-state deal cannot be reached.
