California Assault Weapons Ban Struck Down

This is a welcome development:

A federal judge ruled Friday that California’s “assault weapons” ban is unconstitutional.

The court found the state’s ban on the sale of AR-15s and other popular rifles violated the Second Amendment. Judge Roger Benitez [of the United States District Court for the Southern District of California] ruled the guns targeted by California are in common use. He said the state ran afoul of the Constitution in restricting access to them.

“This case is not about extraordinary weapons lying at the outer limits of Second Amendment protection,” Benitez wrote. “The banned ‘assault weapons’ are not bazookas, howitzers, or machineguns. Those arms are dangerous and solely useful for military purposes. Instead, the firearms deemed ‘assault weapons’ are fairly ordinary, popular, modern rifles.

“This is an average case about average guns used in average ways for average purposes.”

California’s ban is one of the oldest and most aggressive in the country. It was instituted in 1989 but has been expanded multiple times in the decades since. The state added more guns and features to the ban. Eventually, it banned the possession of unregistered “assault weapons” before the latest iteration of the ban was challenged by gun-rights groups in federal court.

Benitez said the AR-15’s versatility made it widely popular in the United States, and that popularity is part of what gives it protection under the Second Amendment. He compared the modular firearm to a “Swiss Army Knife” and noted its use for home defense and civil defense.

“Good for both home and battle, the AR-15 is the kind of versatile gun that lies at the intersection of the kinds of firearms protected under District of Columbia v. Heller and United States v. Miller,” he said. “Yet, the State of California makes it a crime to have an AR15 type rifle. Therefore, this Court declares the California statutes to be unconstitutional.”

1989 means the ban even predates the cosmetic Clinton-era “assault weapon” ban intended to ban ARs, AKs, and most modern sporting rifles. Indeed, the Roberti-Roos Assault Weapons Control Act of 1989 was the model the Clinton Administration used for their own ban, including the dreaded barrel shroud. Roberti-Roos is also the source of California’s infamous ban on detachable magazines and those holding more than 10 rounds.

For those that say the Republican Party has been completely useless at achieving conservative objectives, I would point to the appointment of strong Federalist Society and pro-Second Amendment judges as one of many counter examples. Without Reagan and Bush41, we don’t get Scalia and Thomas, and without them we don’t get Heller. Indeed, without originalist judges, the Second Amendment would probably have been legislated away entirely by now…

Constitutional Carry Passes

Good news! The Texas legislature just sent Constitutional Carry to the Governor’s desk:

After passing different versions of House Bill (HB) 1927, a bill to allow Texans over the age of 21 who can legally possess a handgun to carry it in public without a government-issued permit, both the Texas House and Senate approved a final version of the legislation that will now be sent to Gov. Greg Abbott’s desk.

Abbott said earlier this year that he would sign the bill, known as “constitutional carry.”

“The House was very proud of the version of the bill that we sent over and the Senate was very proud of the amendments that they added,” Rep. Matt Schaefer (R-Tyler), the bill’s author, told The Texan.

“We felt like some of the protections for law-abiding citizens were diminished in the Senate version, and so we fought to get some of that back.”

After the Senate approved the bill with a number of amendments tailored to concerns voiced by law enforcement, the bill returned to the House where Schaefer decided to send the bill to what is known as a “conference committee.”

In the conference committee, five members from each chamber worked out the differences in the two versions to create a compromise known as the conference committee report.

The ultimate version of HB 1927 contained many of the variations of the amendments that were included in the version passed by the Senate rather than what the House first approved.

After being signed into law, Constitutional Carry will go into effect September 1.

The good news is the extension of protection for our constitutional rights, and may create a whole new cohort of legal gun owners in Texas. The bad news is that this might make it even harder to find ammo…

  • Joe Biden declares war on America:

    The country had “done nothing about immigration in 30 years,” (most of them under Clinton and Obama), except that under Trump illegal immigration was reduced by 90 percent, and the principal problem was effectively solved until Biden stopped construction of the southern border wall and reopened the borders. He said it was time to do something about the ”dreamers” but that was not the policy of his party when Trump attempted to help them. Biden called for resources to deal with the “root cause of why people are fleeing” Central America as if it were the business of the United States to raise the welfare of those poor countries, and feed more graft into them, rather than to monitor its own border and apply a sane system of an admission of immigrants.

    He revived the old Obama nonsense about combating employment with unionized green jobs, and leaped into the time warp of bygone days with the bunk that “the middle class built the country and the unions built the middle class, and we must promote the right to unionize.” Unions today are an almost wholly retrograde force redundant to market pressures for higher wages and better working conditions and largely confined to the stagnant backwater the public sector.

    The former administration created huge numbers of “millionaires and billionaires who cheat on their taxes…adding $2 trillion of debt and extending the pay disparity between the chief executive and the lowest wage earner to 320 to 1.” Naturally ignored were the facts that under his predecessor the income taxes of 83 percent of taxpayers were reduced, the number of positions to be filled exceeded the number of unemployed by over 750,000 and the lowest 20 percent of income-earners was in percentage terms gaining income more swiftly than the top ten percent.

    He taxed the former administration with “trickle-down” economics, though that charge was leveled at President Reagan’s massively popular and successful economic policies. Most outrageously, Biden took all credit for 220 million vaccinations with no hint that if it had not been for Trump’s direct intervention to accelerate the development of vaccines, none of it would have happened.

    Almost as disingenuous was the claim that House of Representatives Bill Number 1, which would effectively eliminate any serious method of verifying the validity of individual votes, is really an attack on the Republican effort to attack “the sacred right to vote.“ That bill is almost certainly unconstitutional, would institutionalize and protect mass ballot harvesting, and it ignores the fact that 77 percent of Americans support photo-identification for voters.

    The climate was again bandied as an “existential crisis” even though Biden acknowledged that the U.S. only provides 15 percent of the world’s carbon emissions. He also omitted to mention its splendid record in reducing those omissions even though there remains no convincing argument that they are relevant to the alleged crisis. Foreign affairs was an unrecognizable dreamworld: ”while leading with our allies” and “working closely“ with them to deal with Iran and North Korea, (principally by recommitting the West to acquiescing in Iranian nuclear militarization), he will ”stand up to (Chinese leader) Xi” whom he realizes is ”in deadly earnest” in his determination to supplant the United States as the world’s most important country.

    After the usual reassertion that everyone is created equal, Biden slipped in the need to ”root out systemic racism that plagues America… White supremacy is terrorism” and has “surpassed Jihadism” as a menace. He gave no hint of what he thinks of organizations that are constantly threatening to burn America down if they’re not successful in extracting a full-body immersion in self-humiliation from the majority of Americans who despise all racism. Rarely in his rabidly bowdlerized summary of the nation’s affairs does the president allow the truth to intrude. This made the opposition response by Sen. Tim Scott of South Carolina particularly effective.

  • Dissecting Biden’s lies.

    Biden tried to persuade his audience that gun violence has exploded due to the expiration of the ban on “assault weapons” in the early 2000s.

    In fact, says [David] Harsanyi, “the rate of gun homicide continued falling for more than a decade after the ban ended, even though gun ownership exploded.” Indeed, “from 2006, overall homicides fell ten out of 14 years” and “twenty-one years after a gun violence peaked in 1993, and a decade after the assault-weapon ban ended, homicides by firearms hit a historic low.”

  • Unions Sell Out Their Own Workers for the Biden Energy Plan“:

    Another pro-President Joe Biden union just told its rank-and-file members: Sorry, guys, you are all fired.

    Last week, the United Mine Workers of America union endorsed Biden’s energy policies. Yes, you read that right. The coal-mining union bosses have embraced a bill that outlaws coal mining.

    This is about as dumb as the Pipefitters Union endorsing Biden for president. He repaid them with his first act as president — killing the Keystone pipeline. So now we have the Pipefitters Union against pipelines and the coal miners union against coal.

    Did anyone bother to actually ask the rank-and-file members what they thought? Can they get their union dues back?

    They should. The livelihoods of more than 50,000 coal miners just got sold down the river by their own union bosses.

  • “Bill to Ban Critical Race Theory from Texas Classrooms Passes House Committee.”

    State Reps. Steve Toth (R-The Woodlands) and James White (R-Hillister) are each carrying an identical duplicate of the bill, though the Public Education Committee of the Texas House only passed Toth’s. White’s twin never received a hearing.

    The bill tackles a number of educational tactics feared by some Republicans to be nascent trends in the classroom, such as “action civics,” overly political curriculums, and a strain of sociological thought which organizes racism through structural rather than interpersonal terms, translated from academia to popular literacy by bestselling writers such as Ibram X. Kendi and commonly called “critical race theory.”

    Specifically, the bill would adjust three key areas of education: the state curriculum, classroom education, and training for teachers and other employees.

    It would require the State Board of Education to include an understanding of the country’s founding documents in the state curriculum standards, as well as an understanding of “the fundamental moral, political, and intellectual foundations of the American experiment in self-government.”

    On top of barring teachers from asking students to engage in political activism, the bill would also forbid teachers from promoting racial preferences or concepts like inherent racism and racial guilt. It bans similar ways of teaching with regards to gender, such as fostering guilt on account of sex, teaching inherent or unconscious sexism, and encouraging worse treatment for one sex over another.

    Lastly, it would forbid “training, orientation, or therapy that presents any form of race or sex stereotyping or blame on the basis of race or sex” for school employees.

    Good. Critical Race Theory is pure poison.

  • Tape leaks exposing the truth about Iran’s government:

    Deeply embarrassing leaked audio has surfaced which has sparked a crisis in Iran and which may negatively impact ongoing nuclear talks in Vienna. Iranian Foreign Minister Javad Zarif was heard in audio confirmed by The New York Times as authentic saying that the Islamic Revolutionary Guard Corps (IRGC) overrules many government decisions, strongly suggesting it’s the military that’s actually fully in control of the country. While this may be to some degree stating the obvious, it’s hugely unexpected for Iran’s top civilian diplomat to actually candidly admit as much. One state media newspaper has already emphasized it’s a major “scandal” for the country.

    Zarif is typically very guarded, but in the tapes that surfaced Sunday (it’s unclear at this point the origin of the leak) he’s heard discussing slain Guard Gen. Qassem Soleimani and how the elite commander undermined him in a variety of ways, noting he often went against Iran’s interests. The audio interview took place over two months ago, reports say, and was intended as a classified “oral history” project covering President Rouhani’s two terms in office from Zarif’s perspective.

    “In the Islamic Republic the military field rules,” Zarif is heard telling a pro-government journalist.”I have sacrificed diplomacy for the military field rather than the field servicing diplomacy.” He goes so far as to say that Soleimani would often task himself as Iran’s top diplomat with “requirements”.

  • “John Kerry, Enemy of Israel“:

    We know now that former secretary of state John Kerry isn’t merely a critic of Israel; he is an adversary. In leaked audiotapes obtained by the U.K.-based Iran International, as reported by the New York Times, Iranian foreign minister Mohammad Javad Zarif told a supporter that the former secretary of state had informed him about “at least” 200 covert Israeli actions against Iranian interests in Syria. Zarif listened to this information in “astonishment.”

    A high-ranking American official feels comfortable sharing this information with an autocratic adversary — a government that’s murdered hundreds of Americans, regularly kidnapped them, interfered with our elections, and propped up a regime that gasses its people — about the covert actions of a long-time American ally. What else did he tell Zarif? The Times doesn’t say.

    It wouldn’t be surprising if Israel was more reluctant to share intel with the United States when Democrats such as Kerry show more fondness for those making genocidal threats against the Jewish people than they do for the state that protects them. It’s worth remembering that others like Senator Chris Murphy (who is now “requesting a classified briefing” on the Natanz incident, in which Israel likely sabotaged a nuclear facility) also secretly met with Zarif in Munich in a coordinated effort to undercut the Trump administration’s efforts to derail Iran’s ongoing nuclear-weapons program — an incident that comports far more closely with the definition of “collusion” than anything turned up against Trump officials. We have no idea what Murphy discussed with Zarif, either.

    We do know that after the assassination of Qasem Soleimani — head of the Revolutionary Guard’s Quds Force and the terror group behind the death of over 600 American servicemen and thousands of others — Kerry and Murphy were among the many people scaremongering over a “massive regional war” that never materialized. In his leaked conversation, Zarif says of Soleimani that “by assassinating him in Iraq, the United States delivered a major blow to Iran, more damaging than if it had wiped out an entire city in an attack.”

  • Illinois judge finds state firearms ID law unconstitutional:

    “A citizen in the State of Illinois is not born with a Second Amendment right. Nor does that right insure when a citizen turns 18 or 21 years of age. It is a façade. They only gain that right if they pay a $10 fee, complete the proper application, and submit a photograph.

    If the right to bear arms and self-defense are truly core rights, there should be no burden on the citizenry to enjoy those rights, especially within the confines and privacy of their own homes. A citizen’s Second Amendment rights should not be treated in the same manner as a driver’s license.”

  • “One Year After George Floyd, Minneapolis Is ‘Murderapolis‘ Again.”

    It simply cannot be disputed that the prevalence of unjust killing and violence in the Twin Cities area has vastly increased since last summer’s protests and riots. Minneapolis recorded its second-most homicides ever in 2020 — after only 1995, when the city was ignobly dubbed “Murderapolis” in national media. And the trend has continued to escalate in 2021: between January 1 and April 25, the number of homicides increased by 92% compared to the same period in 2020. More than 80% of the shooting victims in 2020 were black.

    “We’re gonna blow Murderopolis off the charts this year,” one Minneapolis cop told me. (Names in this post have been withheld or partially redacted. As you may be aware, there is often intense suspicion of journalists amongst both civilians and police.)

    The situation is roughly the same in Saint Paul, which tied its all-time record for homicides in 2020. This year, it is on pace to break that record comfortably. The latest homicide was on Sunday night; a man was shot and killed outside a bar in an apparent carjacking. I visited the bar the following day and there was hardly any sign something was amiss — the manager only insisted that the killing had nothing to do with the bar. (Carjackings in the area have surged to an astronomical degree…)

    “There’s way more people it seems like with guns now than there ever has been,” another Minneapolis cop told me, and “much less hesitation to use them.” These officers theorize that the explanation for the crime surge is related to the city’s political climate over the past year, which in their view has allowed perpetrators to wreak havoc without consequence. “They feel emboldened and they feel untouchable, in my opinion,” the cop said.

    The Federal Drug Administration (FDA) is preparing to institute more measures to safeguard black lives by banning products they like. After it was announced that the Biden administration would prohibit the sale of menthol cigarettes, officials are looking at other ways the government can save the black community from itself.

    Only days after the menthol ban was announced, the FDA declared that it was pushing full steam ahead with its effort to rescue the black community through what they refer to as “strategic race-based prohibition.” An FDA official explained that the fried fowl and grape-flavored cola – also known as “grape drank” – must be banned because “these hopeless negroes don’t know how to act.”

    “Preventing black people from killing themselves by banning certain products is the least we can do given the level of oppression they have endured in this country,” said a high-ranking member of the Biden administration. “This is why fried chicken and grape soda have to go.”

    He added: “How could they possibly survive if we don’t make these decisions for them?”

    I wanted to compile a list of the Trump Administration’s pluses and minuses (and, indeed, still might). One source I was going to draw from was the WhiteHouse.gov list of Trump Accomplishments. However, the Biden Administration took that down. As a service, and for the Historical Record, I’ve fished that list out of the Wayback Machine and am posting it below. (Plus you never know when the Biden Administration might ask the Wayback Machine to remove it from their records.) I’ve even tried to replicate the formatting.

    Achieved a record-setting economic comeback by rejecting blanket lockdowns.

    • An October 2020 Gallup survey found 56 percent of Americans said they were better off during a pandemic than four years prior.
    • During the third quarter of 2020, the economy grew at a rate of 33.1 percent – the most rapid GDP growth ever recorded.
    • Since coronavirus lockdowns ended, the economy has added back over 12 million jobs, more than half the jobs lost.
    • Jobs have been recovered 23 times faster than the previous administration’s recovery.
    • Unemployment fell to 6.7 percent in December, from a pandemic peak of 14.7 percent in April – beating expectations of well over 10 percent unemployment through the end of 2020.

    Tax Relief for the Middle Class

    Passed $3.2 trillion in historic tax relief and reformed the tax code.

    • Signed the Tax Cuts and Jobs Act – the largest tax reform package in history.
    • More than 6 million American workers received wage increases, bonuses, and increased benefits thanks to the tax cuts.
    • A typical family of four earning $75,000 received an income tax cut of more than $2,000 – slashing their tax bill in half.
    • Doubled the standard deduction – making the first $24,000 earned by a married couple completely tax-free.
    • Doubled the child tax credit.
    • Virtually eliminated the unfair Estate Tax, or Death Tax.
    • Cut the business tax rate from 35 percent – the highest in the developed world – all the way down to 21 percent.
    • Small businesses can now deduct 20 percent of their business income.
    • Businesses can now deduct 100 percent of the cost of their capital investments in the year the investment is made.
    • Since the passage of tax cuts, the share of total wealth held by the bottom half of households has increased, while the share held by the top 1 percent has decreased.
    • Over 400 companies have announced bonuses, wage increases, new hires, or new investments in the United States.
    • Over $1.5 trillion was repatriated into the United States from overseas.
    • Lower investment cost and higher capital returns led to faster growth in the middle class, real wages, and international competitiveness.

    Jobs and investments are pouring into Opportunity Zones.

    • Created nearly 9,000 Opportunity Zones where capital gains on long-term investments are taxed at zero.
    • Opportunity Zone designations have increased property values within them by 1.1 percent, creating an estimated $11 billion in wealth for the nearly half of Opportunity Zone residents who own their own home.
    • Opportunity Zones have attracted $75 billion in funds and driven $52 billion of new investment in economically distressed communities, creating at least 500,000 new jobs.
    • Approximately 1 million Americans will be lifted from poverty as a result of these new investments.

    Welcome to another Friday LinkSwarm! This one may be a little short because I was busy buying books last night. This roundup is also light on Democratic National Convention news because, really, who has time to watch that garbage?

  • President Donald Trump is the last bulwark against the deluge:

    Perhaps 70 percent of Trumpism remains a hodgepodge of Reaganism: strong defense, realist foreign policy, deregulation, smaller government, big deficits, tax cuts, energy growth, and stars-and-stripes traditionalism.

    But it is the other unorthodox 30 percent that excited his base, terrified conservative apostates, and won Trump the 2016 election by energizing between 4 million and 6 million voters in swing states who had either given up on Republicans, or on elections altogether. NeverTrumpers talk of Trump’s demise and their own resurrection as Phoenixes to rebirth the GOP. They have no idea that those who despise them had ensured their Beltway-preferred candidates could rarely win; nothing has changed since.

    Most hated Trump not because he hated or ridiculed them, but because he found them useless, as we saw from the fixations of John Brennan and James Clapper to the dazed pundits of NeverTrump to the wise men of the retired military.

    What created the hatred of Trump and his supporters, then, was not a rather heterodox political agenda (see below), but a style that took on the Left on its own terms, and shocked a Republican establishment—again not just by conjuring the specter of Lee Atwater, but by shrugging as irrelevant his ostracism by the traditional conservative beltway insider.

    Joe Biden has claimed the recent historic establishment of diplomatic relationships between Israel and the United Arab Emirates was not of the Trump Administration’s own making, but the logical epilogue to years of hard Obama Administration foundational work.

    Biden is right in a sense. For eight years, his Obama team sought to empower Iran—through the lifting of sanctions; through the flawed Iran Deal; through appeasement of Hezbollah, the Assads, and Hamas; through estrangement of the Arab Gulf States and Israel—all as a bizarre Persian/Shiite counterweight to the Sunni Arab world and the U.S.-Israeli special relationship.

    Obama and Biden so succeeded that they drove Israel and Gulf States to seek an-enemy-of-my-enemy-is-my-friend realist partnership, whose fruition we witnessed last week.

    We forget, however, when Trump entered office, that Israel was isolated. Egypt, Jordan, and the Gulf States were bewildered by U.S. neutrality in the Middle East. Iran was ascendant. The “jayvees” of ISIS had overrun much of Iraq with delusions of caliphate grandeur. The Ottomanizing Recep Tayyip Erdoğan was supposedly our new trusted “bridge” between East and West.

    Less than four years later, Iran is isolated, broke, and a veritable client of China. ISIS was bombed out of existence. Israel and much of the Arab world are more worried about Iran than they are about each other. The Palestinians are not the key to regional peace. Turkey is recognized as the rogue that it had become while relations with Greece have warmed.

    The United States is energy independent of the Middle East, as is Israel—because of the expansion of fracking and horizontal drilling that a Biden-Harris Administration claims would cease upon assuming office.

    For all the hoax of “Russian collusion,” Vladimir Putin is in terrible shape and has not fooled the administration as he did with “reset” in the Obama years. In the last four years, the United States upped sanctions on Russia, crashed the world export market of natural gas and oil so dear to Moscow, beefed up NATO spending, hectored Germany about its new energy dependence on Putin, increased U.S. military capability, reached out to frontline Eastern Europe, left an asymmetrical missile deal with Russia, obliterated Russian mercenaries in Syria, sold lethal weapons to Ukraine—even as the likes of James Clapper, John Brennan, James Comey, and an array of retired generals sermonized that Trump was a Russian “asset.” Translated that means the president who contained Putin they loathed, and the Obama presidency that empowered him they idolized.

    Trump is neither a traditional conservative in the Ronald Reagan mode nor a centrist establishmentarian Republican like John McCain or Mitt Romney. But he has done more culturally for the conservative cause than any president since Calvin Coolidge. Like him or not, he has appointed more constructionist federal judges at all levels than any prior Republican president in a single term.

    He likewise has been more opposed than any prior Republican to the current culture of abortion on demand. His education secretary is trying to enforce the Bill of Rights on what have become sometimes neo-fascistic college campuses, and to discourage race-based set asides and de facto discrimination on the basis of race.

    He is a defender of the police while acknowledging the need for greater oversight, and opposed both violence in the streets, and the appeasement of it by blue state governors and mayors. In some sense, there are no conservatives, either by temperament or by political ability, eager to stop the summer madness of statue toppling, arson, spiraling crime, shakedowns, cancel culture and the vows of Antifa and BLM that all this is the beginning of a complete rewriting of American history and a radical recalibration of our shared futures.

    Between the abyss and what goes on in Portland and the Magnificent Mile, there is for the moment nothing else but Trump standing in the breach.

    No president in the history of the Republic has ever been targeted for removal by the opposition party, the permanent bureaucracy, and members of his own party, and in such an illegal and unethical manner.

    There was the first impeachment effort, the Beltway punditry in early 2017 calling for his removal by coup if necessary, the voting machine suits, the Clinton-Obama-Steele subversion of the Trump campaign and transition, the Hollywood assassination chic, the effort to take out former National Security Advisor Michael Flynn, the farce of the 25th Amendment that included the bathos of high federal officials contemplating wearing wires in private conservations with the president to the psychodrama of Professor Bandy Lee testifying before Congress about Trump’s mental state, the silly Emolument Clause gambit (Trump has lost over $1 billion while in office and taking no salary), the subversion of the FISA courts, the Russian hoax, Robert Mueller’s two-year long and $35 million witch hunt, the fabricated Steele dossier implanted in the bowels of the Obama government and media, the one-phone-call impeachment circus, the revolt of the retired generals, and what has rightly lately been called “coup porn,” the hysteria over Ukraine and the caricaturing of Trump in 2020 as Typhoid Mary, Herbert Hoover, and Bull Connor as the Left weaponized the contagion, quarantine, and rioting.

    The Left, the media, and the NeverTrump Right rarely now any more argue all of the above was warranted or based on verifiable wrongdoing, but see the mish-mash instead as a righteous “any means necessary” tactic to achieve the noble end of destroying a president that they detest.

    That Trump is still standing is an unrecognized tribute to his resilience, stamina, and willpower to fight it out to the bitter end.

    His critics say 2020 is not 2016. This time the polls are right on, not rigged by the sort who trafficked in absurd Russian hoaxes or were mesmerized by Michael Avanetti. The silent Trump voters no longer exist, they add. The suburban mom, we are told, fears Trump’s temper more than Antifa. The fence-sitter is bothered more by tweeting than Biden’s ever-longer moments of confused silence. And on and on.

    Perhaps.

    But Americans at some point empathize with an underdog fighter on behalf of what they fear may be a fading America, even someone they are not always fond of, but who does not give up when bullied and subjected to a level of unwarranted abuse that they themselves know they could never endure. The Left never wished to beat Trump at the polls (indeed they feared such an ordeal); they instead wanted to destroy his person, his family, and everyone who followed him.

    That Trump withstood such illegal, unconstitutional, and unethical venom also says something about those who dished it out—and, in the end, did so viciously and yet so impotently.

  • “I think the Democrats want Trump to win“:

    One of the more perplexing things was the DNC giving a speaking slot to former Ohio governor and noted mailman’s son John Kasich. Kasich brings slightly less excitement than dryer lint to any gathering he graces but what was most amusing was that during the somnambulant lead-up to the DNC, the Democrats were acting like Kasich was a real big get for them.

    He’s a milquetoast squish Republican whom no Republicans like anymore, so he tucked tail and went begging for attention crumbs from the Democrats, which is the way of the spineless squishes. After backstabbing his own party to score points with the Democrats and their flying monkeys in the media, Kasich then — as Matt details at Townhall — crapped all over his hosts by disparaging Bartender of the Year Alexandria Ocasio-Cortez.

  • Speaking of the Russian collusion hoax, Kevin Clinesmith, the now Ex-FBI lawyer near the center of Crossfire Hurricane, just pled guilty, “admitting that he altered an email that he used to apply for a FISA warrant against former Trump-campaign adviser Carter Page…The guilty plea marks the first conviction in the probe of the Russia investigation led by U.S. Attorney for Connecticut John Durham.”
  • A bit more Clinesmith background:

    Of all of the Obama administration loyalists who contributed to the Russia collusion hoax, Clinesmith is the one most obviously guilty of a felony: he altered an email he received from the CIA to say that Carter Page was NOT a CIA source, when in fact the email said Page WAS a CIA source, and submitted that fake document to the federal court in order to obtain a FISA warrant. That is worth five years in prison and, of course, the end of his legal career. Clinesmith’s guilty plea is significant, in part, because he may be willing to implicate others who are higher in the DOJ chain of command.

    Fox News host Laura Ingraham reported Wednesday evening that she obtained a chain of State Department emails stemming from a standard request for comment from New York Times journalist Ken Vogel, whose reporting helped generate scrutiny of Hunter Biden’s ties to Ukrainian gas company Burisma. Hunter Biden, 49, is the son of Democratic presidential front-runner Joe Biden, and Republicans have called for him to testify during the Ukraine-related Senate impeachment trial against President Trump.

    On May 1, 2019, Vogel contacted State Department official Kate Schilling about a story he was working on regarding an Obama administration meeting in January 2016 with Ukrainian prosecutors and mentioned the name of the CIA analyst believed to be the whistleblower whose complaint sparked impeachment proceedings that led to two articles of impeachment: abuse of power and obstruction of Congress.

    The Chinese government has placed the city of Wuhan under quarantine in an attempt to stop the spread of the deadly, pneumonia-like virus called 2019-nCoV.

    According to a Chinese news bulletin, all passenger transportation out of the city has been temporarily suspended. That means that the city’s 11 million residents, hundreds of whom have fallen ill and at least nine of whom have died from the viral outbreak, are trapped unless they receive special permission to leave.

    The virus quickly spread to nearby Japan, Thailand, and South Korea, and a traveler from Wuhan also carried it to the U.S.

    In the face of a global outbreak, the Chinese government has been trying to maintain control of the narrative, censoring media and deleting social media posts that don’t align with its official statements.

    What if they had a Second Amendment rally in Virginia and and nobody got shot?

    You and I know that there was never going to be any violence coming from Second Amendment advocates, and that if any started it was going to come from antifa. But oddly enough, antifa didn’t seem interested in showing up to confront armed opponents.

    Funny how that happens.

    It must have been a great blow to an MSM falsely accusing the event of being a “white supremacist” rally.

    They were heartbroken:

    “Nobody has so much as fired a shot. This is an unbelievable tragedy,” said one teary-eyed MSNBC reporter, clearly caught up in the anguish of the moment. “It’s tragic that we live in a country where reporters who are just minding their own business trying to push a narrative can have everything ripped away from them in an instant when protesters refuse to shoot at people.”

    The media was hoping for a second Charlottesville, but without paid agitators and a police force willing to channel two sets of protestors into each other, it never materialized.

    More NRA Troubles: Wayne LaPierre And The Iron Law of Bureaucracy

    Lots more NRA turmoil has bubbled up since my previous piece, including the NRA filing two lawsuits against PR firm Ackerman McQueen and leaks of internal NRA letters expressing alarm over profligate spending. In addition to spending by Ackerman McQueen, a great deal of concern has been expressed over NRA’s outside attorney record Brewer Attorneys & Counselors, headed by William Brewer III. Then this week, NRA-ILA head Chris Cox was suspended and put on administrative leave and NRA-TV shut down production on new content.

    Lets tackle these in chronological order.

    As he was being shoved out the door, now-Ex NRA President Oliver North and NRA First Vice President Richard Childress penned a letter expressing deep concern about how much of NRA’s money was going to Mr. Brewer:

    As indicated in previous correspondence, we and others continue to be deeply concerned about the extraordinary legal fees the NRA has incurred with Brewer Attorneys & Counselors. The amount appears to be approximately $24 million over a 13-month period, $5 million of which apparently has been reimbursed in connection with the Lockton settlement.

    The Lockton settlement was the Lockton insurance company reaching an out-of-court settlement to the NRA over breaching a contract to underwrite the ill-fated Carry Guard program discussed last post.

    North and Childress complained about “lax management” of Brewer invoices in the past, and pushed for “an independent, outside expert to review the Brewer invoices immediately.”

    From April 2018 through February 2019, Brewer was billing the NRA $1 million to $2 million a month. North and Childress stated that “Invoices of this size for 12 months of work appear to be excessive and pose an existential threat to the financial stability of the NRA.”

    John Richardson of No Lawyers – Only Guns and Money suggests that Brewer was attempting to become a one-stop shop featuring legal services, public relations and communications, all in one big, expensive, billable bundle. One wonders whether the NRA authorized him to do anything beyond the legal work and, if so, why were they paying him to do some of the tasks they were already paying Ackerman McQueen so handsomely to perform. Richardson also wonders what the attorney of record for the NRA is doing sending political donations to such notable “pro-gun” luminaries as Beto O’Rourke, Patrick Kennedy and Hillary Clinton.

    North and Childress aren’t the only ones dissatisfied with NRA leadership. Boards member Lt. Col. Allen West has called on LaPierre to resign. Says West:

    I do not support Wayne LaPierre continuing as the EVP/CEO of the NRA. The vote in Indianapolis was by acclamation, not roll call vote. There is a cabal of cronyism operating within the NRA and that exists within the Board of Directors. It must cease, and I do not care if I draw their angst. My duty and responsibility is to the Members of the National Rifle Association, and my oath, since July 31, 1982, has been to the Constitution of the United States, not to any political party, person, or cabal.

    The NRA Board of 76 is too large and needs to be reduced to 30 or less. We need term limits of four (4) terms on the Board. We need to focus the NRA, the nation’s oldest civil rights organization on its original charter, mission, training and education in marksmanship, shooting sports, and the defense of the Second Amendment.

    I will dedicate all my efforts to the reformation of the National Rifle Association and its members, of whom I am proud to serve.

    I attended the NRA Annual Meeting of Members on Saturday morning, and I am writing about a contentious resolution that came to the floor. The resolution decried recent reports of fiscal mismanagement centered around one of the NRA’s primary vendors, Ackerman McQueen. Among other things, the resolution called for the resignation of members of the Audit Committee as well as the NRA’s Executive Vice President, Mr. Wayne LaPierre. In light of the pending litigation between Ackerman McQueen and the NRA, Secretary Frazer successfully moved that the resolution be referred to the Board of Directors for consideration in consultation with legal counsel.

    As a practicing attorney, I fully understand the NRA’s interest in limiting public discussion of sensitive matters that are currently being litigated. I agree that the Association is best served by addressing the resolution internally rather than in the public sphere. However, I also understand the arguments raised against referring the motion to the Board. The resolution cited allegations of financial misconduct, self-dealing, and conflicts of interest within the Board of Directors, the Audit Committee, and other parts of the NRA’s leadership team, based on their alleged mishandling of vendor contracts and other business relationships with Ackerman McQueen. In other words, referring the resolution to the Board would be, in effect, asking the Board to adjudicate allegations against itself.

    I want the National Rifle Association to succeed. At Saturday morning’s meeting, Mr. LaPierre himself warned of the mounting existential threats we now face, both in the courtroom and in the court of public opinion. Given the intensified scrutiny facing the Association right now, I fear that yet another maneuver of impropriety (whether real or perceived) could be a proverbial death knell. It would serve as perfect fodder for the media to publish yet another scathing exposé that paints the NRA as roiled in unsavory scandal. It would also incite even more resentment from within the organization and sow more division among our ranks. Although Mr. Frazer’s motion to refer the resolution did ultimately succeed, the fierce opposition voiced by many in attendance shows that members want this issue to be addressed in a more transparent fashion.

    I have a humble suggestion to help avoid public airing of private business while also quelling further cries of impropriety. When the Board addresses this resolution, I request that any Board member, officer, or staff member who has a personal, financial, or fiduciary interest in, or fidelity to, Ackerman McQueen (or its subsidiary and affiliate companies) — as an employee, contractor, paid consultant, vendor, client, etc. — be required to recuse himself/herself from discussing and voting on this resolution. That way, regardless of how the Board ultimately disposes of the resolution, at least the result will be less vulnerable to accusations of ethically dubious entanglements.

    Fast forwarding to the present, the removal of Chris Cox from NRA-ILA was quite unexpected, at least by me. ILA is generally considered not only among the most effective of NRA’s programs, but one of the most effective (if not the most effective) lobbying groups on Capitol Hill.

    The news yesterday regarding the National Rifle Association was headlined by a story in the New York Times that said Chris Cox, head of the NRA-ILA, was suspended and put on administrative leave. This followed a late Wednesday filing in New York Supreme Court (the trial level courts in that state) in which the NRA sought a declaratory judgment that Ollie North was not entitled to his legal expenses as a director of the NRA. Also suspended was Scott Christman who served as Cox’s deputy chief of staff at the NRA-ILA.

    Both Cox and Christman are accused along with NRA Board member and former Congressman Dan Boren of participating in a failed “coup” attempt orchestrated by Ackerman McQueen and Ollie North. Cox vehemently denies this.

    “The allegations against me are offensive and patently false,” Cox said. “For over 24 years I have been a loyal and effective leader in this organization. My efforts have always been focused on serving the members of the National Rifle Association, and I will continue to focus all of my energy on carrying out our core mission of defending the Second Amendment.”

    PA Gun blog wonders just just who can suspend Cox, since he reports directly to the NRA board of directors. Say Uncle wonders if LaPierre even has a plan. “Is this some sort of scorched-earth move?”

    Stopping production on NRA-TV is much less of a surprise, given that was yet another thing run out of Ackerman McQueen. I asked NRA-TV personalities Dana Loesch and Colion Noir on Twitter if they had been informed of the moves and have not received a reply. According to LaPierre the issue was one of “focus”:

    “Many members expressed concern about the messaging on NRATV becoming too far removed from our core mission: defending the Second Amendment,” Wayne LaPierre, the N.R.A.’s longtime chief executive, wrote in a message to members that was expected to be sent out by Wednesday. “So, after careful consideration, I am announcing that starting today, we are undergoing a significant change in our communications strategy. We are no longer airing ‘live TV’ programming.”

    Unlike some of LaPierre’s other flailing moves, this one can largely be written off as a straight-forward cost-saving measure and an inevitably byproduct of the Ackerman McQueen lawsuit. There’s also probably some truth to the “focus” angle as well, though from a self-interested “free blogging content good” perspective, I liked a good deal of what they were doing, such as Noir’s look at the astounding rate of homeless crime in Seattle.

    Ammoland is not impressed with the moves:

    Enough is enough. The National Rifle Association’s Board of Directors needs to act to get things under control and to focus the organization’s energy and activities against major threats to our right to keep and bear arms instead of internal squabbles. The current legal fight and internal chaos have to be resolved immediately.

    I have already been on record as suggesting that Wayne LaPierre leaves as Executive Vice President after the 2020 election. But recent developments, including the suspension of NRA-ILA Executive Director Chris Cox, now make some changes more necessary than ever. While LaPierre and Cox have past successes, the current drama, and the failure to see the new threats from corporations and social stigmatization that were part of the other side’s long game, including Andrew Cuomo’s abuses of power rank as significant failures on their part, and in combination with the internal drama, and Wayne’s lack of proper basic business management all warrant their replacement.

    Who should replace Cox, who obviously no longer has the complete confidence of his superiors at NRA? Whoever it is should not be a lobbyist, but instead should probably have close ties to grassroots activists. With Cuomo’s attacks tying up financial resources, having the activists on the ground will be more important than ever.

    LaPierre’s replacement will also need to come sooner, rather than later.

    At this point, this replacement should come from outside the NRA so as to have no connection with the current drama.

    Richardson agrees: “Wayne LaPierre’s scorched earth approach to maintaining power may be good for Wayne but is horrible for the NRA as an organization. I acknowledge there are many good people on the Board of Directors. Some want Wayne gone and some still support him.”

    I have to concur. The Ackerman McQueen separation and lawsuit was a necessary corrective given a large vendor whose financial drain endangered the organization. The NRA-TV move is quite defensible as a necessary cost-cutting measure. But the Cox suspension, absent any additional information about why the move had to be made, reeks of circling the wagons and sheer vindictiveness on LaPierre’s part. Ironically, it is his out-sized overreaction to an alleged “coup” that proves why a move against LaPierre is both justified and, at this point, probably sadly necessary.

    Jerry Pournelle’s Iron Law of Bureaucracy states that in any bureaucratic organization there are two kinds of people: Those devoted to the goals of the organization, and those dedicated to the organization itself. “The Iron Law states that in every case the second group will gain and keep control of the organization. It will write the rules, and control promotions within the organization.” LaPierre’s NRA is clearly been captured by the second group. Or to put it another way: “Every great cause begins as a movement, becomes a business, and eventually degenerates into a racket.” LaPierre’s NRA has become a racket. The NRA exists to serve its members and protect the Second Amendment, not to serve and protect Wayne LaPierre.

    As I said about the NRA previously:

    There are some that claim cleaning up the NRA would offer too much succor to the gun-grabbers. But the organizational dysfunction and self-dealing is already out in the open, and is already hurting the NRA’s effectiveness (and has been for several years). If not now, when? Better to do it now, the year before a Presidential election, with Republicans holding the White House and the Senate able to block gun-grabbing initiatives, than during it.

    Other than being a member, I am very far indeed from the center of NRA power. For all the grumbling over the NRA caving over bump-stocks, there’s no other organization with the size, scope and political power of the NRA to protect Second Amendment rights in America. But to do that, the NRA has to be on solid organizational and financial footing, and right now it does not appear to be on either. The NRA has to get its own house in order, this year, or expect forces hostile to it and its goals to do it for them.

    At this point, getting the NRA’s house in order necessitates Wayne LaPierre’s exit as Executive Vice President. This is not going to be easy, as (to quote Archer) “He’s dug in there like a tick!”

    But enough is enough.

    Update: Chris Cox has resigned. There’s also mention of NRA-ILA making a “substaintial” loan to the NRA, and refusing to do it again, followed immediately by Cox and Christman’s suspension. This is probably a good time to reiterate my call for a forensic audit of NRA finances…

    President Trump’s Speech To The NRA

    Back in 2016, one of the knocks on then-candidate Donald Trump was that he was soft on Second Amendment rights, having backed the Clinton “assault weapons” ban in the 1990s. However, Trump’s views clearly evolved, as 18 years ago he stated he was against a handgun ban (“Democrats want to confiscate all guns, which is a dumb idea because only the law-abiding citizens would turn in their guns and the bad guys would be the only ones left armed.”), and Hillary Clinton was so bad on the Second Amendment that it was easy for the NRA to endorse him.

    Fast forward to today, and not only has President Trump kept almost all his promises on the issue (the bump stock ban, which the NRA itself went soft on, being a notable exception), he just gave an enthusiastically received speech to the National NRA convention.

    It was a speech full of red meat, and ranged considerably beyond the Second Amendment to border control, crime, sanctuary cities, and the deep state.

    A few excerpts:

    Every day of my administration, we are taking power out of Washington, D.C. and returning it to the American people, where it belongs. (Applause.) And you see it now better than ever, with all of the resignations of all of the bad apples. They’re bad apples. They tried for a coup; didn’t work out so well. (Applause.) And I didn’t need a gun for that one, did I? (Laughter.)

    All was taking place at the highest levels in Washington, D.C. You’ve been watching, you’ve been seeing. You’ve been looking at things that you wouldn’t have believed possible in our country. Corruption at the highest level — a disgrace. Spying, surveillance, trying for an overthrow. And we caught them. We caught them. (Applause.) Who would have thought in our country?

    Far-left radicals in Congress want to take away your voice, your jobs, your rights, and they especially want to take away your guns. You know that. They want to take away your guns. You better get out there and vote. You better get out there and vote. It seems like it’s a long ways away. It’s not.

    Democrats want to disarm law-abiding Americans while allowing criminal aliens to operate with impunity. But that will never happen as long as I’m your President. Not even close. (Applause.) I promise to defend the Second Amendment rights of every American, and I always will. I’ll never let you down. (Applause.) Never let you down. I haven’t so far, and I won’t. Because as the famous saying goes, when guns are outlawed, only outlaws will have guns. Very simple. (Applause.)

    As we protect gun rights for law-abiding citizens, we are also getting guns out of the hands of violent criminals.

    When I took office two years ago, one of my highest priorities was to reduce violent crime. In the two years before my inauguration, the murder rate had increased by more than 20 percent, and the United States had experienced the largest increase in violent crime in over 25 years.

    For this reason, my administration resurrected Project Safe Neighborhoods, bringing together prosecutors, police, sheriffs, and citizens groups to put the most dangerous offenders behind bars.

    We funded 200 new violent crime prosecutors. We charged a record number of criminal offenders. And last year, we prosecuted the most violent criminals ever in our history.

    And now, violent crime is way down. Murders in America’s largest cities dropped by 6 percent between 2017 and 2018. But I do have to ask you: What the hell is going on in Chicago? What is going on? (Applause.) We could solve that problem. We would’ve been down even a lot more. And it’s not a tough problem to solve. You got to let law enforcement do what they have to do. They’ll solve the problem very quickly. Very quickly. (Applause.)

    We don’t think enough about the victims. They’re too worried about the people that cause the crime. It’s got to stop. That thought process is no good.

    The number of police officers shot and killed in the line of duty last year, I’m so happy to report, is down 21 percent compared to the year before. (Applause.) And that was the year before I took office.

    President Trump also announced he was withdrawing America from the UN Arms Trade Treaty:

    in the last administration, President Obama signed the U.N. Arms Trade Treaty. And in his waning days in office, he sent the treaty to the Senate to begin the ratification process.

    This treaty threatened your subjugate — and you know exactly what’s going on here — your rights and your constitutional and international rules and restrictions and regulations.

    Under my administration, we will never surrender American sovereignty to anyone. (Applause.) We will never allow foreign bureaucrats to trample on your Second Amendment freedom. And that is why my administration will never ratify the U.N. Arms Trade Treaty. I hope you’re happy. (Applause.)

    I’m impressed; I didn’t think too many of you would really know what it is. You what it is? A big, big factor. But I see a couple of very happy faces from the NRA over there.

    And I am officially announcing today that the United States will be revoking the effect of America’s signature from this badly misguided agreement. We’re taking our signature back. (Applause.) The United Nations will soon receive a formal notice that America is rejecting this treaty. (Applause.)

    President Trump also brought up several people who used guns to defend their lives against bad guys, including Sutherland Springs hero Stephen Willeford.

    NRA members had doubts about Donald Trump’s commitment to the Second Amendment when he announced he was running for President. I don’t see any having those doubts anymore.
